Ce document analyse l'utilisation qui a été faite de la catégorie d'état de fait inconstitutionnel (ICE) dans la jurisprudence de la Cour constitutionnelle colombienne et de la Cour constitutionnelle péruvienne, et compare les similitudes et les différences dans l'application de la figure dans les deux cas. En complément, il analyse l'ICE à la lumière de la doctrine du contentieux stratégique, défini comme la réclamation judiciaire sous la forme d'actions individuelles ou collectives qui cherchent la transformation structurelle des institutions de l'État dans la poursuite du respect des droits démocratiques et des valeurs consacrées dans les Constitutions.

O artigo analisa o uso que tem sido feito da categoria de estado de coisas inconstitucional (ECI) na jurisprudência do Tribunal Constitucional colombiano e do Tribunal Constitucional peruano, e compara as semelhanças e diferenças na aplicação da figura em ambos os casos. Complementarmente, analisa o ECI à luz da doutrina do litígio estratégico, definido como a pretensão judicial sob a forma de acções individuais ou colectivas que visam a transformação estrutural das instituições do Estado em busca do respeito pelos direitos e valores democráticos consagrados nas Constituições.

Il documento analizza l'uso che è stato fatto della categoria di stato di cose incostituzionale (ECI) nella giurisprudenza della Corte costituzionale colombiana e della Corte costituzionale peruviana, e confronta le somiglianze e le differenze nell'applicazione della figura in entrambi i casi. Inoltre, analizza l'ECI alla luce della dottrina del contenzioso strategico, definito come la rivendicazione giudiziaria sotto forma di azioni individuali o collettive che mirano alla trasformazione strutturale delle istituzioni statali per il rispetto dei diritti e dei valori democratici sanciti dalle Costituzioni.

The paper analyzes the use given to the category of unconstitutional state of affairs (ECI) in the jurisprudence of the Constitutional Court of Colombia and the Peruvian Constitutional Court, and compares the similarities and differences in the application of the figure in both cases. Complementarily, it analyzes the ECI in the light of the doctrine on strategic litigation, defined as the judicial claim in the form of individual or collective actions that seek the structural transformation of State institutions in pursuit of respect for democratic rights and values enshrined in the Constitutions.

Der Beitrag analysiert die Verwendung der Kategorie des verfassungswidrigen Zustands (ECI) in der Rechtsprechung des kolumbianischen Verfassungsgerichts und des peruanischen Verfassungsgerichts und vergleicht die Ähnlichkeiten und Unterschiede in der Anwendung der Figur in beiden Fällen. Ergänzend wird die EBI im Lichte der Doktrin der strategischen Prozessführung analysiert, die als gerichtliche Forderung in Form von individuellen oder kollektiven Klagen definiert wird, die auf eine strukturelle Veränderung der staatlichen Institutionen abzielen, um die in den Verfassungen verankerten demokratischen Rechte und Werte zu wahren.
