»Indirect Discrimination. Constitutional criticism of a questionable concept of equality«: The German legislature is constitutionally required to enact primarily gender-neutral regulations. Based on this premise the question arises whether gender-neutral provisions can bear gender-discriminatory effect. Ultimately, gender-neutral regulations do not inhere the same discriminatory quality as directly discriminatory regulations. In most cases, indirect discrimination on the basis of gender is a matter of reflecting disadvantages that result from raising children.
