In the international sphere, we see different positions with regard to trade names and their protection, in some countries they are registered as trademarks and in others they are made viable by obtaining a Reservation of Rights to the Exclusive Use of a stage name granted by an institution created for this purpose. In Cuba there are no specific regulations on this matter, so it is essential to delimit what would be the best protection for this institution in our legal system.Artistic Names are not Trademarks or Works, object of Copyright protection, but should have an independent protection from those used in Cuban practice and in most international legislations, having as its main manifestation the creative one, linked to the artistic field, so they constitute a sui generis figure consisting of a denomination used by the artist or group of them, to identify the artist or group of artists before the public.

No âmbito internacional, vemos diferentes posições em relação aos nomes comerciais e à sua proteção, em alguns países são registados como marcas e noutros são viabilizados através da obtenção de uma Reserva de Direitos de Uso Exclusivo de um nome artístico concedida por uma instituição criada para o efeito. Em Cuba não existe regulamentação específica sobre esta matéria, pelo que é fundamental delimitar qual seria a melhor proteção para esta instituição no nosso ordenamento jurídico.Os Nomes Artísticos não são Marcas ou Obras, objeto de proteção do Direito de Autor, mas devem ter uma proteção independente das utilizadas na prática cubana e na maioria das legislações internacionais, tendo como principal manifestação a criativa, ligada ao campo artístico, pelo que constituem uma figura sui generis que consiste numa denominação utilizada pelo artista ou grupo deles, para identificar o artista ou grupo de artistas perante o público.

Dans la sphère internationale, on observe différentes positions en ce qui concerne les noms commerciaux et leur protection. Dans certains pays, ils sont enregistrés en tant que marques et dans d'autres, ils sont rendus viables par l'obtention d'une réserve de droits pour l'utilisation exclusive d'un nom de scène accordée par une institution créée à cet effet. À Cuba, il n'existe pas de réglementation spécifique en la matière ; il est donc essentiel de déterminer quelle serait la meilleure protection pour cette institution dans notre système juridique.Les noms artistiques ne sont pas des marques ou des ¿uvres protégées par le droit d'auteur, mais ils devraient bénéficier d'une protection indépendante de celle des noms utilisés dans la pratique cubaine et dans la plupart des législations internationales, car ils ont pour principale manifestation la créativité, liée au domaine artistique, et constituent donc une figure sui generis consistant en une dénomination utilisée par l'artiste ou le groupe d'artistes pour identifier l'artiste ou le groupe d'artistes devant le public.

In ambito internazionale si riscontrano posizioni diverse in merito ai nomi commerciali e alla loro protezione, in alcuni Paesi vengono registrati come marchi e in altri sono resi praticabili attraverso l'ottenimento di una Riserva di Diritti all'Uso Esclusivo di un nome d'arte concessa da un'istituzione creata a questo scopo. A Cuba non esistono norme specifiche in materia, per cui è essenziale delimitare quale sia la migliore protezione per questa istituzione nel nostro sistema giuridico.I nomi artistici non sono marchi o opere, oggetto di tutela del diritto d'autore, ma dovrebbero avere una protezione indipendente da quelli utilizzati nella prassi cubana e nella maggior parte delle legislazioni internazionali, avendo come manifestazione principale quella creativa, legata all'ambito artistico, per cui costituiscono una figura sui generis che consiste in una denominazione utilizzata dall'artista o da un gruppo di essi, per identificare l'artista o il gruppo di artisti di fronte al pubblico.

Auf internationaler Ebene gibt es unterschiedliche Positionen in Bezug auf Handelsnamen und deren Schutz. In einigen Ländern werden sie als Marken eingetragen, in anderen werden sie durch eine Reservierung der Rechte zur ausschließlichen Nutzung eines Künstlernamens durch eine zu diesem Zweck geschaffene Institution nutzbar gemacht. In Kuba gibt es keine spezifischen Vorschriften zu diesem Thema, so dass es wichtig ist, abzugrenzen, was der beste Schutz für diese Institution in unserem Rechtssystem wäre.Künstlernamen sind keine Marken oder Werke, die unter den Schutz des Urheberrechts fallen, sondern sollten einen unabhängigen Schutz von denen genießen, die in der kubanischen Praxis und in den meisten internationalen Gesetzgebungen verwendet werden, da sie in erster Linie eine schöpferische, mit dem künstlerischen Bereich verbundene Manifestation darstellen, so dass sie eine Figur sui generis bilden, die aus einer vom Künstler oder einer Gruppe von Künstlern verwendeten Bezeichnung besteht, um den Künstler oder die Gruppe von Künstlern vor der Öffentlichkeit zu identifizieren.
