La CEMAC est une organisation internationale d'intégration sous régionale, qui a pour objectif principal le développement harmonieux et réciproque des Etats membres. Dans l'espoir d'atteindre cet objectif, la Communauté a mise sur pieds un droit qui régis les actions des protagonistes communautaires. Ce droit, s¿il est respecté par tous favoriserait le développement de cette dernière. Cette logique justifie cependant la sacralisation du principe de légalité au sein de la CEMAC. Ce travail contribue à démontrer comment de manière concrète la légalité des actes y est garantie, ou alors comment cette légalité y est assurée. Nous avons pu remarquer avec réserve que la CEMAC est une communauté de droit. Du moins, sur le plan textuel (dispositions législatives), au travers des normes en amont elle prévient l¿illégalité des actes en conditionnant l¿élaboration de ceux-ci à des impératifs de plusieurs ordres, conduisant ainsi soit à la validité ou à l¿invalidité de l¿acte; en aval sanctionne au travers de ses institutions le non-respect du droit en général tout en donnant la possibilité à toute personne de faire prévaloir son droit en saisissant le juge communautaire.

CEMAC is an international organization for sub-regional integration, whose main objective is the harmonious and reciprocal development of its member states. In the hope of achieving this objective, the Community has set up a law governing the actions of its protagonists. This law, if respected by all, would promote the Community's development. This logic, however, justifies the sacralization of the principle of legality within CEMAC. This work contributes to demonstrating how, in concrete terms, the legality of acts is guaranteed, or how this legality is ensured. We have been able to note with reservation that the CEMAC is a community of law. At the very least, at the textual level (legislative provisions), through upstream norms it prevents the illegality of acts by conditioning their elaboration to imperatives of several orders, thus leading either to the validity or invalidity of the act; downstream, through its institutions, it sanctions non-compliance with the law in general, while giving all persons the possibility of asserting their rights by bringing the matter before the community judge.

Na esperança de alcançar este objetivo, a Comunidade estabeleceu uma lei que rege as acções dos protagonistas da Comunidade. Este direito, se fosse respeitado por todos, favoreceria o desenvolvimento da Comunidade. No entanto, esta lógica justifica a sacralização do princípio da legalidade no seio da CEMAC. Este trabalho contribui para demonstrar como é que, em termos concretos, a legalidade dos actos é garantida, ou como é que esta legalidade é assegurada. Constatámos com reserva que a CEMAC é uma comunidade de direito. Pelo menos, a nível textual (disposições legislativas), através de normas a montante, previne a ilegalidade dos actos, submetendo a sua redação a imperativos de várias ordens, conduzindo assim à validade ou à invalidade do ato; a jusante, através das suas instituições, sanciona o incumprimento da lei em geral, dando a qualquer pessoa a possibilidade de fazer valer o seu direito recorrendo aos tribunais comunitários.

Con la esperanza de alcanzar este objetivo, la Comunidad ha establecido una ley que rige las acciones de los protagonistas de la Comunidad. Esta ley, si es respetada por todos, promoverá el desarrollo de la Comunidad. Sin embargo, esta lógica justifica la sacralización del principio de legalidad en el seno de la CEMAC. Este trabajo contribuye a demostrar cómo se garantiza concretamente la legalidad de los actos, o cómo se asegura esta legalidad. Hemos constatado con reservas que la CEMAC es una comunidad de derecho. Al menos, en el plano textual (disposiciones legislativas), a través de normas ascendentes previene la ilegalidad de los actos sometiendo su redacción a imperativos de varios órdenes, lo que conduce a la validez o a la invalidez del acto; en el plano descendente, a través de sus instituciones, sanciona el incumplimiento de la ley en general, al tiempo que ofrece a cualquier persona la posibilidad de hacer valer su derecho acudiendo a los tribunales comunitarios.

Die CEMAC ist eine internationale Organisation für subregionale Integration, deren Hauptziel die harmonische und gegenseitige Entwicklung der Mitgliedsstaaten ist. In der Hoffnung, dieses Ziel zu erreichen, hat die Gemeinschaft ein Recht geschaffen, das die Handlungen der Protagonisten der Gemeinschaft regelt. Dieses Recht würde, wenn es von allen eingehalten wird, die Entwicklung der Gemeinschaft fördern. Diese Logik rechtfertigt jedoch die Sakralisierung des Legalitätsprinzips innerhalb der CEMAC. Diese Arbeit trägt dazu bei, aufzuzeigen, wie auf konkrete Weise die Legalität von Handlungen dort garantiert wird, bzw. wie diese Legalität dort sichergestellt wird. Wir haben mit Vorbehalt festgestellt, dass die CEMAC eine Rechtsgemeinschaft ist. Zumindest auf der textlichen Ebene (Rechtsvorschriften) verhindert sie durch vorgelagerte Normen die Rechtswidrigkeit von Rechtsakten, indem sie deren Ausarbeitung an verschiedene Erfordernisse knüpft, die entweder zur Gültigkeit oder zur Ungültigkeit des Rechtsakts führen; nachgelagert sanktioniert sie durch ihre Institutionen die Nichteinhaltung des Rechts im Allgemeinen und gibt jeder Person die Möglichkeit, ihr Recht durch Anrufung des Gemeinschaftsrichters geltend zu machen.

La CEMAC è un'organizzazione internazionale di integrazione subregionale il cui obiettivo principale è lo sviluppo armonioso e reciproco dei suoi Stati membri. Nella speranza di raggiungere questo obiettivo, la Comunità ha stabilito una legge che regola le azioni dei suoi protagonisti. Questa legge, se rispettata da tutti, promuoverebbe lo sviluppo della Comunità. Tuttavia, questa logica giustifica la sacralizzazione del principio di legalità all'interno della CEMAC. Questo lavoro contribuisce a dimostrare come concretamente sia garantita la legalità degli atti, o come questa legalità sia assicurata. Abbiamo notato con riserva che la CEMAC è una comunità di diritto. Almeno a livello testuale (disposizioni legislative), attraverso norme a monte impedisce l'illegalità degli atti subordinando la loro redazione a imperativi di diversi ordini, che portano alla validità o all'invalidità dell'atto; a valle, attraverso le sue istituzioni, sanziona l'inosservanza del diritto in generale, dando a chiunque la possibilità di far valere i propri diritti ricorrendo ai tribunali comunitari.
