El Presidente de la República es una institución fundamental en la RD del Congo. Es la figura política central. Como tal, la Constitución le otorga poderes que ejerce en solitario o comparte con el Primer Ministro, jefe del Gobierno. Sin embargo, los poderes constitucionales atribuidos al Presidente de la República pueden extenderse más allá del marco constitucional en el mundo real. Estos poderes pueden ampliarse o reducirse, en función del voto de la mayoría. Por ello, el presente trabajo analiza cada uno de los hechos mayoritarios en el contexto congoleño, y su impacto en el alcance de los poderes del Presidente de la República.

Der Präsident der Republik ist eine Scharnierinstitution in der DR Kongo. Er ist die zentrale politische Figur. In diesem Sinne erkennt ihm die Verfassung Befugnisse zu, die er entweder allein ausübt oder die er sich mit dem Premierminister, dem Regierungschef, teilt. Die dem Präsidenten der Republik von der Verfassung zugewiesenen Befugnisse können jedoch über den verfassungsrechtlichen Rahmen hinausgehen und in die Welt der Tatsachen vordringen. Die genannten Befugnisse können je nach Mehrheitsentscheidung entweder erweitert oder eingeschränkt werden. In der vorliegenden Arbeit werden daher die einzelnen Mehrheitstatsachen im kongolesischen Kontext sowie ihre Auswirkungen auf den Umfang der Befugnisse des Präsidenten der Republik analysiert.

O Presidente da República é uma instituição central na RD Congo. É a figura política central. Como tal, a Constituição confere-lhe poderes que exerce sozinho ou que partilha com o Primeiro-Ministro, o chefe do governo. No entanto, os poderes constitucionais atribuídos ao Presidente da República podem estender-se para além do quadro constitucional, no mundo real. Estes poderes podem ser alargados ou reduzidos em função da maioria. O presente documento analisa, portanto, cada um dos factos maioritários no contexto congolês e o seu impacto no âmbito dos poderes do Presidente da República.

Il Presidente della Repubblica è un'istituzione cardine della RD Congo. È la figura politica centrale. In quanto tale, la Costituzione gli conferisce poteri che esercita da solo o che condivide con il Primo Ministro, il capo del governo. Tuttavia, i poteri costituzionali attribuiti al Presidente della Repubblica possono estendersi al di là del quadro costituzionale nel mondo reale. Questi poteri possono essere estesi o ridotti a seconda della maggioranza. Il presente lavoro analizza quindi ciascuno dei fatti di maggioranza nel contesto congolese e il loro impatto sulla portata dei poteri del Presidente della Repubblica.

The President of the Republic is a pivotal institution in DR Congo. He is the central political figure. As such, the Constitution grants him powers that he either exercises alone or shares with the Prime Minister, head of government. However, the constitutional powers attributed to the President of the Republic are likely to go beyond the constitutional framework and into the real world. These powers can either be enlarged or narrowed, depending on the majority fact. The present work therefore analyzes each of the majority facts in the Congolese context, and their impact on the scope of the powers of the President of the Republic.

Le Président de la République est une institution charnière en RD Congo. Il y est la figure politique centrale. Dans ce sens, la Constitution lui reconnaît des pouvoirs soit qüil exerce seul soit qüil partage avec le Premier ministre, chef du gouvernement. Cependant, les pouvoirs constitutionnels attribués au Président de la République sont susceptibles d¿excéder le cadre constitutionnel pour naviguer dans l¿univers des faits. Lesdits pouvoirs peuvent soit s¿élargir soit être rétrécis selon le fait majoritaire. Ainsi, la présente ¿uvre analyse chacun des faits majoritaires dans le contexte congolais, ainsi que leur impact dans l¿étendue des pouvoirs du Président de la République.
