Die Verfassungsproduktion in Kamerun ist lückenhaft. Nach einem halben Jahrhundert des Konstitutionalismus glänzen die kamerunischen Verfassungstexte nicht gerade durch ihre Verständlichkeit und Klarheit. Eine Lektüre der verschiedenen Grundgesetze, die das Land erlebt hat, lässt Paradoxien erkennen, die die Verankerung des Konstitutionalismus behindern. Die Verfassung vom 18. Januar 1996, die Gegenstand der vorliegenden Studie ist, ist von dieser Feststellung nicht ausgenommen. Zwar hat sie die Institutionen und den Staat modernisiert, aber ihr Wortlaut ist verbesserungswürdig. Zwischen Schweigen, Zweideutigkeiten, Widersprüchen und Verwirrung ist sie voller Paradoxien, die sowohl in der Semantik der Verfassung als auch in den Optionen des Verfassungsgebers erkennbar sind. Dieser Text, der zwischen Fortschritten und Rückschlägen, Kohärenz und Inkohärenz schwankt, ermöglicht es, die Grundlage der Drangsale des kamerunischen Konstitutionalismus zu erkennen.

Constitutional production is deficient in Cameroon. After half a century of constitutionalism, Cameroon's constitutional texts do not shine in terms of their intelligibility and clarity. A reading of the various fundamental laws that the country has known reveals paradoxes that hinder the entrenchment of constitutionalism. The Constitution of 18 January 1996, which is the subject of this study, is not immune to this observation. It is true that it has modernised the institutions and the State, but there is room for improvement in its writing. Between silence, ambiguities, contradiction and confusion, it abounds in numerous paradoxes that are perceptible both in the constitutional semantics and in the options of the constituent. Oscillating between advances and setbacks, coherence and inconsistency, this text allows us to perceive the basis of the tribulations of Cameroonian constitutionalism.

La produzione costituzionale è carente in Camerun. Dopo mezzo secolo di costituzionalismo, i testi costituzionali camerunesi non brillano per intelligibilità e chiarezza. La lettura delle varie leggi fondamentali che il Paese ha conosciuto rivela paradossi che ostacolano il radicamento del costituzionalismo. La Costituzione del 18 gennaio 1996, oggetto di questo studio, non è immune da questa osservazione. È vero che ha modernizzato le istituzioni e lo Stato, ma la sua scrittura può essere migliorata. Tra silenzi, ambiguità, contraddizioni e confusione, abbonda di numerosi paradossi, percepibili sia nella semantica costituzionale che nelle opzioni del costituente. Oscillando tra progressi e battute d'arresto, coerenza e incoerenza, questo testo ci permette di percepire la base delle tribolazioni del costituzionalismo camerunese.

A leitura das diferentes leis fundamentais que o país conheceu revela paradoxos que dificultam o enraizamento do constitucionalismo. A Constituição de 18 de Janeiro de 1996, objecto do presente estudo, não é imune a esta constatação. É verdade que modernizou as instituições e o Estado, mas a sua redacção pode ser melhorada. Entre silêncios, ambiguidades, contradições e confusões, ela abunda em numerosos paradoxos perceptíveis tanto na semântica constitucional como nas opções do constituinte. Oscilando entre avanços e recuos, coerência e incoerência, este texto permite-nos perceber a base das tribulações do constitucionalismo camaronês.

La producción constitucional es deficiente en Camerún. Tras medio siglo de constitucionalismo, los textos constitucionales cameruneses no brillan por su inteligibilidad y claridad. La lectura de las diferentes leyes fundamentales que ha conocido el país revela paradojas que obstaculizan el afianzamiento del constitucionalismo. La Constitución de 18 de enero de 1996, objeto de este estudio, no escapa a esta observación. Es cierto que ha modernizado las instituciones y el Estado, pero su redacción es mejorable. Entre el silencio, las ambigüedades, la contradicción y la confusión, abunda en numerosas paradojas perceptibles tanto en la semántica constitucional como en las opciones del constituyente. Oscilando entre avances y retrocesos, coherencia e incoherencia, este texto permite percibir la base de las tribulaciones del constitucionalismo camerunés.

Après un demi-siècle de constitutionnalisme, les textes constitutionnels camerounais ne brillent pas par leur intelligibilité et leur clarté. Une lecture des différentes lois fondamentales qüa connu le pays permet de déceler des paradoxes qui entravent l¿enracinement du constitutionnalisme. La Constitution du 18 janvier 1996, objet de la présente étude n¿échappe pas à ce constat. Certes, elle a procédé à la modernisation des institutions et de l¿Etat mais, son écriture est perfectible. Entre silence, ambigüités, contradiction et confusion, elle regorge de nombreux paradoxes qui sont perceptibles à la fois dans la sémantique constitutionnelle que dans les options du constituant. Oscillant entre avancées et reculades, cohérences et incohérences, ce texte permet de percevoir le fondement des tribulations du constitutionnalisme camerounais.
