Ce travail analyse les limites de l'activisme judiciaire du point de vue de l'État constitutionnel. Le problème qui a guidé la recherche est la question de savoir s'il existe une légitimité démocratique pour l'activisme judiciaire en relation avec l'atténuation des droits fondamentaux incarnés par les libertés individuelles dans le système de l'État constitutionnel. Parmi les objectifs spécifiques de la recherche, nous cherchons à identifier les relations de pouvoir dans l'État contemporain et les garanties constitutionnelles pour la protection du citoyen ; à comprendre comment les droits fondamentaux et les libertés du citoyen ont évolué dans l'État de droit démocratique ; et à vérifier la fonction juridictionnelle et les limites de l'interprétation des membres du pouvoir judiciaire sous l'égide de l'État constitutionnel.

Este trabajo analiza los límites del Activismo Judicial desde la perspectiva del Estado Constitucional. El problema que orientó la investigación involucra la cuestión de si existe legitimidad democrática para el Activismo Judicial en relación a la mitigación de los Derechos Fundamentales encarnados en las libertades individuales en el sistema del Estado Constitucional. Entre los objetivos específicos de la investigación, pretendemos identificar las relaciones de poder en el Estado contemporáneo y las garantías constitucionales para la protección del ciudadano; comprender cómo han evolucionado los Derechos Fundamentales y las libertades del ciudadano en el Estado Democrático de Derecho; y verificar la función jurisdiccional y los límites de interpretación de los Miembros del Poder Judicial en la égida del Estado Constitucional.

Questo lavoro analizza i limiti dell'attivismo giudiziario dalla prospettiva dello Stato costituzionale. Il problema che ha guidato la ricerca riguarda la questione della legittimità democratica dell'attivismo giudiziario in relazione all'attenuazione dei diritti fondamentali incarnati dalle libertà individuali nel sistema dello Stato costituzionale. Lo Stato di diritto, la tripartizione dei poteri e i diritti fondamentali sono il pilastro dello Stato costituzionale e sono concepiti per proteggere i diritti dell'individuo di fronte agli abusi dello Stato. Tra gli obiettivi specifici della ricerca, cerchiamo di identificare i rapporti di potere nello Stato contemporaneo e le garanzie costituzionali per la protezione del cittadino; di capire come si sono evoluti i diritti fondamentali e le libertà del cittadino nello Stato democratico di diritto; e di verificare la funzione giurisdizionale e i limiti dell'interpretazione dei membri della magistratura nell'egida dello Stato costituzionale.

Diese Arbeit analysiert die Grenzen des richterlichen Aktivismus aus der Perspektive des Verfassungsstaates. Das Problem, das die Forschung leitete, ist die Frage, ob es eine demokratische Legitimation für richterlichen Aktivismus in Bezug auf die Abschwächung der Grundrechte gibt, die in den individuellen Freiheiten im System des Verfassungsstaates verkörpert sind. Zu den spezifischen Forschungszielen gehört es, die Machtverhältnisse im heutigen Staat und die verfassungsmäßigen Garantien für den Schutz des Bürgers zu ermitteln, zu verstehen, wie sich die Grundrechte und die Freiheiten des Bürgers im demokratischen Rechtsstaat entwickelt haben, und die Rechtsprechungsfunktion und die Grenzen der Auslegung der Mitglieder der Judikative unter der Ägide des Rechtsstaates zu überprüfen.

This work analyses the limits of Judicial Activism from the perspective of the Constitutional State. The problem that guided the research involves the question of whether there is democratic legitimacy for Judicial Activism in relation to the mitigation of Fundamental Rights embodied in individual freedoms in the system of the Constitutional State. The rule of law, the tripartition of powers and Fundamental Rights are the mainstay of the Constitutional State and are designed to protect the rights of the individual in the face of abuse by the State. Among the specific research objectives, we seek to identify the power relations in the contemporary State and the constitutional guarantees for the protection of the citizen; to understand how Fundamental Rights and the freedoms of the citizen have evolved in the Democratic State of Law; and to verify the jurisdictional function and the limits of interpretation of the Members of the Judiciary in the aegis of the Constitutional State.
