Constitutional Mutation, i.e. the informal changing of the text of the constitution, has been an increasingly present phenomenon in the Brazilian legal system, above all as a result of the Supreme Court's constantly changing position, which has brought a range of consequences to the legal system. The main objective of this work, which was carried out through extensive bibliographical research, is to analyze the effects of Interpretative Constitutional Mutation operated by the Federal Supreme Court, as well as to establish the parameters to be observed by the Supreme Court when resorting to this institute. Due to the binding nature of its decisions, the position of the Supreme Court has the power to change the legal situation and existing social realities, while according to its understanding it can create or restrict rights. However, the STF's actions are not unlimited and cannot lead to an interpretation that is contrary to the legal system. They must comply with the limits imposed by the normative program and others not provided for in it, otherwise their actions will be considered unconstitutional and illegitimate.

Die Verfassungsmutation, d.h. die informelle Änderung des Verfassungstextes, ist ein zunehmend präsentes Phänomen im brasilianischen Rechtssystem, vor allem als Folge der ständigen Änderung des Verständnisses durch den Obersten Gerichtshof, die eine Reihe von Konsequenzen für das Rechtssystem mit sich gebracht hat. Das Hauptziel dieser Arbeit, die mit Hilfe einer umfangreichen Literaturrecherche durchgeführt wurde, besteht darin, die Auswirkungen der vom Bundesgerichtshof angewandten interpretativen Verfassungsänderung zu analysieren und die Parameter festzulegen, die der Oberste Gerichtshof bei der Inanspruchnahme dieses Instituts beachten muss. Aufgrund der Verbindlichkeit seiner Entscheidungen hat die Position des Obersten Gerichtshofs die Macht, die Rechtslage und die bestehenden sozialen Realitäten zu verändern, wobei er nach seinem Verständnis Rechte schaffen oder einschränken kann. Die Handlungen des STF sind jedoch nicht unbegrenzt und können nicht zu einer Auslegung führen, die der Rechtsordnung widerspricht. Sie müssen die vom normativen Programm auferlegten Grenzen und andere, die darin nicht vorgesehen sind, einhalten, andernfalls werden ihre Handlungen als verfassungswidrig und unrechtmäßig angesehen.

La mutation constitutionnelle, c'est-à-dire la modification informelle du texte de la constitution, est un phénomène de plus en plus présent dans le système juridique brésilien, surtout en raison du changement constant d'interprétation de la Cour suprême, qui a entraîné toute une série de conséquences pour le système juridique. L'objectif principal de ce travail, qui a été réalisé grâce à une recherche bibliographique approfondie, est d'analyser les effets de la mutation constitutionnelle interprétative opérée par la Cour suprême fédérale, ainsi que d'établir les paramètres à observer par la Cour suprême lorsqu'elle recourt à cet institut. En raison de la nature contraignante de ses décisions, la position de la Cour suprême a le pouvoir de modifier la situation juridique et les réalités sociales existantes, tout en créant ou en restreignant des droits. Cependant, les actions du STF ne sont pas illimitées et ne peuvent pas conduire à une interprétation contraire à l'ordre juridique. Elles doivent respecter les limites imposées par le programme normatif et d'autres non prévues par celui-ci, sous peine d'être considérées comme inconstitutionnelles et illégitimes.

La Mutación Constitucional, es decir, el cambio informal del texto de la constitución, ha sido un fenómeno cada vez más presente en el ordenamiento jurídico brasileño, sobre todo como resultado del constante cambio de entendimiento del Tribunal Supremo, que ha traído una serie de consecuencias para el sistema jurídico. El objetivo principal de este trabajo, realizado a través de una amplia investigación bibliográfica, es analizar los efectos de la Mutación Constitucional Interpretativa operada por el Supremo Tribunal Federal, así como establecer los parámetros que deben ser observados por el Supremo Tribunal al recurrir a este instituto. Debido al carácter vinculante de sus decisiones, la posición del Supremo Tribunal tiene el poder de modificar la situación jurídica y las realidades sociales existentes, en tanto que, según su entendimiento, puede crear o restringir derechos. Sin embargo, la actuación del STF no es ilimitada y no puede llevar a una interpretación contraria al ordenamiento jurídico, debiendo respetar los límites impuestos por el programa normativo y otros no previstos en él, caso contrario su actuación será considerada inconstitucional e ilegítima.

La Mutazione Costituzionale, cioè la modifica informale del testo della Costituzione, è un fenomeno sempre più presente nell'ordinamento giuridico brasiliano, soprattutto a causa del costante cambiamento di interpretazione della Corte Suprema, che ha portato una serie di conseguenze al sistema giuridico. L'obiettivo principale di questo lavoro, realizzato attraverso un'ampia ricerca bibliografica, è quello di analizzare gli effetti della Mutazione Costituzionale Interpretativa operata dal Tribunale Supremo Federale, nonché di stabilire i parametri che la Corte Suprema deve osservare quando ricorre a questo istituto. A causa della natura vincolante delle sue decisioni, la posizione della Corte Suprema ha il potere di cambiare la situazione legale e le realtà sociali esistenti, mentre secondo la sua interpretazione può creare o limitare i diritti. Tuttavia, le azioni del STF non sono illimitate e non possono portare a un'interpretazione contraria all'ordinamento giuridico: devono rispettare i limiti imposti dal programma normativo e altri non previsti da esso, altrimenti le loro azioni saranno considerate incostituzionali e illegittime.
