The present work aims to create in students and scholars of the Law an interest in the study, knowledge and deepening of the Forensic Sciences, derived from the importance they have and the contribution they make within the Justice System, as a necessary complement to the set of legal norms that make up the system. It also seeks to warn Judges, Magistrates, Prosecutors, Defenders and other participants in the Justice System, especially in the criminal field, about the risks that an overestimation and blind credibility of the expert evidence can produce; relegating the jurisdictional function and turning the experts into decision-makers of the cases, which is legally incorrect and even dangerous.

Le présent ouvrage vise à susciter chez les étudiants et les spécialistes du droit un intérêt pour l'étude, la connaissance et l'approfondissement des sciences médico-légales, compte tenu de l'importance qu'elles revêtent et de la contribution qu'elles apportent au sein du système judiciaire, en tant que complément nécessaire à l'ensemble des normes juridiques qui le composent. Il vise également à mettre en garde les juges, les magistrats, les procureurs, les défenseurs et les autres acteurs du système judiciaire, en particulier dans le domaine pénal, contre les risques qu'une surestimation et une crédibilité aveugle des preuves d'experts peuvent entraîner, en reléguant la fonction juridictionnelle et en transformant les experts en décideurs dans les affaires, ce qui est juridiquement incorrect et même dangereux.

O presente trabalho tem como objetivo criar nos estudantes e académicos de Direito um interesse pelo estudo, conhecimento e aprofundamento das Ciências Forenses, derivado da importância que têm e da contribuição que prestam no âmbito do Sistema de Justiça, como complemento necessário ao conjunto de Normas Jurídicas que o compõem. Pretende ainda alertar os Juízes, Magistrados, Procuradores, Defensores e demais intervenientes no Sistema de Justiça, em especial no âmbito criminal, para os riscos que uma sobrevalorização e credibilidade cega da prova pericial pode produzir; relegando a função jurisdicional e transformando os peritos em decisores dos processos, o que é juridicamente incorreto e até perigoso.

Il presente lavoro si propone di creare negli studenti e negli studiosi di Diritto un interesse per lo studio, la conoscenza e l'approfondimento delle Scienze Forensi, derivante dall'importanza che esse rivestono e dal contributo che apportano all'interno del Sistema Giudiziario, come necessario complemento all'insieme delle Norme Giuridiche che lo compongono. Inoltre, intende mettere in guardia i Giudici, i Magistrati, i Procuratori, i Difensori e gli altri partecipanti al Sistema Giudiziario, soprattutto in ambito penale, dai rischi che una sopravvalutazione e una cieca credibilità delle prove peritali possono produrre, relegando la funzione giurisdizionale e trasformando gli esperti in decisori dei casi, il che è giuridicamente scorretto e persino pericoloso.

Die vorliegende Arbeit zielt darauf ab, bei Studenten und Rechtswissenschaftlern ein Interesse am Studium, an der Kenntnis und an der Vertiefung der forensischen Wissenschaften zu wecken, das sich aus der Bedeutung und dem Beitrag ergibt, den sie innerhalb des Justizsystems leisten, als notwendige Ergänzung zu den Rechtsnormen, aus denen das System besteht. Außerdem sollen Richter, Staatsanwälte, Verteidiger und andere Teilnehmer am Justizsystem, insbesondere im Bereich des Strafrechts, vor den Risiken gewarnt werden, die eine Überbewertung und blinde Glaubwürdigkeit der Sachverständigenbeweise mit sich bringen kann, wodurch die Funktion der Rechtsprechung zurückgedrängt und die Sachverständigen zu Entscheidungsträgern in den Fällen gemacht werden, was rechtlich falsch und sogar gefährlich ist.
