The book seeks to point out the construction of Truth in Civil Procedure, separating the material (real) Truth from the formal Truth, beginning the studies with the theories that guide Truth, to reinforce the relevance of the Hermeneutic theory and then attacking Truth as correspondence and as relativism. Combating the distorted conceptualisations of Truth that invade the sphere of Civil Procedural Law. For Formal Truth in Civil Procedure has been losing prominence and the trend towards Real (Material) Truth has been gaining strength, revealing an attachment to the inquisitorial system, which is present alongside arbitrary decisions endowed by the judge's instructional powers, which are broad and guided by the New CPC, not altering in such a way the ideological structure of the judge's free conviction, which is linked to the philosophy of conscience, something that is refuted in this work. Judges' investigative powers must be guided by a new system, called neo-inquisitorial, which limits the judge's powers, and the judge must be seen as a historian based on phenomenological hermeneutics, unveiling the truth through the facts and evidence in the case.

Le livre cherche à mettre en évidence la construction de la Vérité dans la procédure civile, en séparant la Vérité matérielle (réelle) de la Vérité formelle, en commençant les études par les théories qui guident la Vérité, pour renforcer la pertinence de la théorie herméneutique et en attaquant ensuite la Vérité comme correspondance et comme relativisme. Combattre les conceptualisations déformées de la Vérité qui envahissent la sphère du droit procédural civil. En effet, la Vérité formelle dans la procédure civile a perdu de son importance et la tendance à la Vérité réelle (matérielle) a gagné en force, révélant un attachement au système inquisitoire, qui est présent à côté des décisions arbitraires conférées par les pouvoirs d'instruction du juge, qui sont larges et guidés par le nouveau CPC, ne modifiant pas de cette manière la structure idéologique de la libre conviction du juge, qui est liée à la philosophie de la conscience, ce qui est réfuté dans cet ouvrage. Les pouvoirs d'investigation des juges doivent être guidés par un nouveau système, appelé néo-inquisitoire, qui limite les pouvoirs du juge, et le juge doit être considéré comme un historien basé sur l'herméneutique phénoménologique, dévoilant la vérité à travers les faits et les preuves de l'affaire.

El libro busca señalar la construcción de la Verdad en el Proceso Civil, separando la Verdad material (real) de la Verdad formal, iniciando los estudios con las teorías que orientan la Verdad, para reforzar la relevancia de la teoría Hermenéutica y luego atacar la Verdad como correspondencia y como relativismo. Combatiendo las conceptualizaciones distorsionadas de la Verdad que invaden el ámbito del Derecho Procesal Civil. Pues la Verdad Formal en el Procesal Civil ha ido perdiendo protagonismo y la tendencia hacia la Verdad Real (Material) ha ido ganando fuerza, revelando un apego al sistema inquisitivo, que se hace presente junto a las decisiones arbitrarias dotadas por las facultades instructoras del juez, que son amplias y orientadas por el Nuevo CPC, no alterando de tal manera la estructura ideológica de la libre convicción del juez, que se vincula a la filosofía de la conciencia, algo que se refuta en esta obra. Las facultades de investigación de los jueces deben estar guiadas por un nuevo sistema, denominado neo-inquisitivo, que limita las facultades del juez, y éste debe ser visto como un historiador basado en la hermenéutica fenomenológica, develando la verdad a través de los hechos y pruebas del caso.

Das Buch versucht, die Konstruktion der Wahrheit im Zivilprozess aufzuzeigen, indem es die materielle (reale) Wahrheit von der formalen Wahrheit trennt, die Studien mit den Theorien, die die Wahrheit leiten, beginnt, um die Relevanz der hermeneutischen Theorie zu stärken und dann die Wahrheit als Korrespondenz und als Relativismus anzugreifen. Bekämpfung der verzerrten Konzeptualisierungen der Wahrheit, die in den Bereich des Zivilprozessrechts eindringen. Denn die formale Wahrheit im Zivilprozess hat an Bedeutung verloren und die Tendenz zur realen (materiellen) Wahrheit hat sich verstärkt, was eine Anhänglichkeit an das inquisitorische System offenbart, das neben den willkürlichen Entscheidungen präsent ist, die durch die weit gefassten und von der Neuen ZPO geleiteten Weisungsbefugnisse des Richters gestützt werden, wobei die ideologische Struktur der freien Überzeugung des Richters, die mit der Gewissensphilosophie verbunden ist, nicht verändert wird, was in diesem Werk widerlegt wird. Die Ermittlungsbefugnisse des Richters müssen sich an einem neuen System orientieren, das als neo-inquisitorisch bezeichnet wird und die Befugnisse des Richters einschränkt. Der Richter muss als Historiker gesehen werden, der sich auf eine phänomenologische Hermeneutik stützt und die Wahrheit anhand der Fakten und Beweise des Falles aufdeckt.

Il libro cerca di evidenziare la costruzione della Verità in Procedura Civile, separando la Verità materiale (reale) dalla Verità formale, iniziando gli studi con le teorie che guidano la Verità, per rafforzare la rilevanza della teoria Ermeneutica e poi attaccando la Verità come corrispondenza e come relativismo. Combattere le concettualizzazioni distorte della Verità che invadono la sfera del Diritto Processuale Civile. Infatti, la Verità formale in Procedura civile ha perso importanza e si è rafforzata la tendenza alla Verità reale (materiale), rivelando un attaccamento al sistema inquisitorio, presente accanto a decisioni arbitrarie dotate di poteri istruttori del giudice, ampi e guidati dal Nuovo CPC, non alterando in tal modo la struttura ideologica del libero convincimento del giudice, legato alla filosofia della coscienza, che viene confutata in quest'opera. I poteri investigativi dei giudici devono essere guidati da un nuovo sistema, detto neo-inquisitorio, che limiti i poteri del giudice, il quale deve essere visto come uno storico basato sull'ermeneutica fenomenologica, che svela la verità attraverso i fatti e le prove del caso.

Junto a obra busca-se apontar a construção da Verdade no Processo Civil, cingindo a Verdade (real) material da Verdade formal, iniciando os estudos com as teorias balizadoras das de Verdade, para reforçar a relevância da teoria Hermenêutica e posteriormente atacar a Verdade como correspondência e como a relativista. Combatendo as conceituações distorcidas de Verdade que invadem a esfera do Direito Processual Civil. Pois, a Verdade Formal no Processo Civil vem perdendo relevo e vem ganhando força a tendência pela Verdade Real (Material), revelando apego ao sistema inquisitorial, o qual se faz presente junto a decisões arbitrárias dotadas pelos poderes instrutórios do Juiz são amplos e balizados pelo Novo CPC, não alterando de tal forma a estrutura ideológica do livre convencimento do Juiz que tem vinculação a filosofia da consciência, algo que é refutado junto ao trabalho. Devem os poderes instrutórios dos juízes terem baliza por um novo sistema, chamado de neo-inquisitorial, que vem a limitar os poderes do Juiz, devendo ser este visto como um Juiz Historiador calcado pela hermenêutica fenomenológica, desvelando a verdade pelos fatos e provas acostados ao Processo.
