Le Venezuela, en tant que pays d'Amérique latine, et conformément à l'histoire de son droit constitutionnel, a une réalité historique peu connue en ce qui concerne les limitations du droit à la liberté et à la propriété. Il était donc nécessaire et pertinent de mener une enquête doctrinale et historico-constitutionnelle sur ces deux institutions afin d'analyser la nature ou le caractère des limitations et restrictions auxquelles elles ont été soumises depuis la naissance de la république. Cela a permis de théoriser une cause possible (peut-être non appréciée) des limitations de ces droits, depuis la loi constitutionnelle de 1811 jusqu'à la loi constitutionnelle actuelle du Venezuela.

Il Venezuela, in quanto Paese iberoamericano e in accordo con la storia del suo diritto costituzionale, ha una realtà storica poco conosciuta per quanto riguarda le limitazioni del diritto alla libertà e alla proprietà. È stato quindi necessario e pertinente realizzare un'indagine dottrinale e storico-costituzionale su questi due istituti per analizzare la natura o il carattere delle limitazioni e delle restrizioni a cui sono stati sottoposti fin dalla nascita della Repubblica. Ciò ha permesso di teorizzare una possibile causa (forse non apprezzata) delle limitazioni a questi diritti, dalla legge costituzionale del 1811 all'attuale legge costituzionale del Venezuela.

Venezuela hat als iberoamerikanisches Land und in Übereinstimmung mit der Geschichte seines Verfassungsrechts eine wenig bekannte historische Realität hinsichtlich der Beschränkungen des Rechts auf Freiheit und Eigentum. Es war daher notwendig und sinnvoll, eine dogmatische und verfassungsgeschichtliche Untersuchung dieser beiden Institutionen vorzunehmen, um die Art oder den Charakter der Beschränkungen und Einschränkungen zu analysieren, denen sie seit der Gründung der Republik unterworfen waren. Dies ermöglichte es, eine Theorie über eine mögliche (vielleicht nicht erkannte) Ursache für die Einschränkungen dieser Rechte aufzustellen, vom Verfassungsrecht von 1811 bis zum aktuellen Verfassungsrecht in Venezuela.

A Venezuela, como país ibero-americano e de acordo com a história do seu direito constitucional, tem uma realidade histórica pouco conhecida no que respeita às limitações do direito à liberdade e à propriedade. Foi, por isso, necessário e pertinente proceder a uma investigação doutrinária e histórico-constitucional destes dois institutos, a fim de analisar a natureza ou o carácter das limitações e restrições a que estiveram sujeitos desde o nascimento da República. Isto permitiu teorizar sobre uma possível causa (talvez não apreciada) das limitações a estes direitos, desde o direito constitucional de 1811 até ao atual direito constitucional da Venezuela.

Venezuela, as an Ibero-American country and in accordance with the history of its constitutional law, has a little known historical reality regarding the limitations of the right to freedom and property. It was therefore necessary and pertinent to carry out a doctrinal and historical-constitutional investigation of these two institutions in order to analyse the nature or character of the limitations and restrictions they have been subject to since the birth of the republic. This made it possible to theorise about a possible (perhaps unappreciated) cause of the limitations to these rights, from the constitutional law of 1811 to the current constitutional law in Venezuela.

Venezuela como país iberoamericano y de acuerdo con la historia de su derecho constitucional tiene una realidad histórica poco conocida acerca de las limitaciones del derecho de libertad y propiedad. Es por lo que se hizo necesario y pertinente hacer una investigación doctrinaria e histórica- constitucional de estas dos instituciones a los fines de analizar la naturaleza o carácter de las limitaciones y restricciones que han sido objeto desde el nacimiento de la república. Esto permitió tener la posibilidad de teorizar sobre una posible causa (quizás no apreciada) que estaría propiciando limitaciones a estos derechos, desde el derecho constitucional de 1811 hasta el derecho constitucional vigente en Venezuela.
