This book argues that competent, consenting adults have a constitutional right to plural marriage. While deconstructing traditional arguments against plural marriage, the author proposes a new legal grounding for marriage that would allow for recognition of a diverse range of intimate relationships.

This book considers how judicial review can be improved to strike the appropriate balance between legislative and judicial power under conditions of moral pluralism. It argues that the reasons that the state offers on behalf of its most important laws should be consistent with the freedom and equality of all persons.
