Diese Frage wird in folgender Arbeit untersucht. Zunächst wird die Rolle der ISA als Organisation zur Verwaltung von Tiefseeressourcen im Namen der Menschheit analysiert. Daraus wird ein rechtspolitischer Erwartungshorizont an die Organisation bestimmt. Daraufhin wird der Status der ISA, d.h. der Rechtsrahmen skizziert. Hierauf wird anhand ausgewählter Problemfelder bestimmt, inwieweit der Rechtsrahmen den aufgestellten Erwartungshorizont erfüllt. Zum Abschluss wird ein Fazit getroffen.Die Entwicklung vom strengen ¿Lotus-Prinzip¿ zu einer kooperativeren Form des Völkerrechts verbreitet sich und steht auch in der nächsten Zeit vor großen Herausforderungen. In keinem Bereich spiegelt sich dies so gut wieder wie in Staatengemeinschaftsräumen. Diese Räume zeichnen sich durch fehlende Besiedlung und dementsprechend fehlender Rechtsordnung aus. Dazu gehören der Weltraum und die Antarktis, die aufgrund ihres Rohstoffreichtums das Interesse vieler Staaten auf sich ziehen. Doch wie sollen diese Rohstoffe verwaltet werden?Ein interessanter Lösungsansatz hat sich in einem weiteren Staatengemeinschaftsraum entwickelt: Dem Meeresboden. Dieser und seine Ressourcen außerhalb nationaler Jurisdiktion wurden im Rahmen des Seerechtsübereinkommens (SRÜ) zum ¿gemeinsamen Erbe der Menschheit¿ (CHM) erklärt. Zusätzlich wurde eine internationale Organisation zur Verwaltung der Ressourcen gegründet ¿ die International Seabed Authority (ISA).
