The focus of this publication is the uniqueness of the Baltic Sea from a legal perspective, and the regulatory voids that result from the multiple layers of regulation this area is subjected to: up to six layers of regulation (general international law, regional conventions, EU law, national laws, local and municipal rules plus a whole range of non-binding norms and other 'soft law' arrangements) act in parallel. However, a large number of rules or regulatory layers does not in itself ensure effectiveness or consistency. When the regulatory landscape is approached from the point of view of individual substantive topics, it is apparent that the norms of different regulatory layers entail both overlaps, gaps and uncertainties, differently for each topic. This publication addresses a selection of topics that are decidedly international in nature, but for which current international and EU rules include important gaps or uncertainties. In addition to presenting a set of legal analyses of topical issues for the region, which in itself is a meritorious objective in view of the relative scarcity of legal studies with a focus on the Baltic Sea, the publication also seeks to analyze the regulatory 'anatomy' of the selected issues in more detail. Through the legal analyses the chapters explore how regulatory gaps are formed, how they are filled, how the rules of the different layers work together and interact with each other in the selected areas. Accordingly, the secondary ambition is to explore, through the chapters, whether more general conclusions can be drawn about the nature of the regulatory gaps and multi-layerism in order to produce a better understanding of how regulations on multiple levels operate in practice.

This Open Access book on Ocean Governance examines sustainability challenges facing our oceans today. The book is organized into three sections: knowledge systems, policy foundations and thematic analyses. The knowledge produced in the book was catalyzed by the scientific outcomes within the European-funded Cooperation in Science and Technology (COST) network ¿Ocean Governance for Sustainability ¿ Challenges, Options and the Role of Science¿. This network brings together scientists, policy-makers and civil society representatives from 28 nation states to cooperate on ocean governance research. This book offers a compilation of new research material including focused case studies, broad policy syntheses and reflective chapters on the history and current status of knowledge production systems on ocean governance. New research material is presented, although some chapters draw on secondary sources. The book starts with synthetic review chapters from the editors, outlining past andpresent knowledge systems, addressing how and why ocean governance for sustainability is where it currently stands with critical reflections on existing narratives, path dependencies and colonialist histories. This is followed by chapters addressing, synthesizing and analyzing different legal and policy frameworks for ocean governance both regionally and internationally. At the core of the book are the thematic analyses, which provide focused case studies with detailed contextual information in support of different ocean governance challenges and sustainability pathways around the world. The book concludes with a chapter explicitly targeting students, researchers and policy-makers with key take-away messages compiled by the editors.

For small-scale fisheries around the world, the Blue Growth and Blue Economy initiatives may provide sustainable development, but only insofar as they align with the global consensus enshrined in the Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries in the context of Food Security and Poverty Eradication. If states do nothing to fulfill the promises they made when they endorsed these guidelines in 2014, the Blue Economy will come at a loss for small-scale fisheries and further their marginalization in the ocean economy. Under the umbrella of Blue Justice, this book demonstrates that these risks are real and must be considered as states implement their sustainable ocean development plans. These are human rights issues, which are embedded into governance principles and institutions and which make a difference for small-scale fisheries people in their daily lives. In stressing the importance of policies and institutions that build on the experiences of small-scale fisheries people in the contexts in which they operate, this book draws on case studies of small-scale fisheries from countries on all continents to clarify what Blue Justice entails for small-scale fisheries and make suggestions for real change. "e;Through the Blue Justice paradigm, this book flags the relevance of recognizing the potential impact that different factors, including the Blue Economy approach, could bring to fishing communities, their livelihoods, cultural traditions, and other potential multidimensional conflicts. Vulnerability in fishing communities can increase and inequalities can be reinforced at different levels if individuals and community capabilities are not strengthened... A first of its kind, not to be missed, this book is informative, purposeful, and pertinent in an era of change"e;. Silvia Salas, CINVESTAV, Marine Resources Department, Merida, Mexico "e;The studies reveal that Blue Justice is a 'governability' issue, which requires establishing 'right' institutions, that are transdisciplinary (integrated), participatory, and holistic. It is implicit from these writings that the SSF Guidelines and Blue Growth initiatives do not form two different discourses, and that the implementation of the former would resolve many of the justice issues caused by the latter, in favor of small-scale fisheries and their communities"e;.  Oscar Amarasinghe, Professor & Chancellor, Ocean University of Sri Lanka and     President, Sri Lanka Forum for Small Scale Fisheries (SLFSSF)

This multi-sited island ethnography illustrates how the embattled politics of (im)mobility, belonging, and patronage among coastal fishing communities in Sri Lankäs militarised northeast have intersected in the wake of civil war. It explores an undertheorized puzzle by asking how the conceptual dualisms between co-operation and contestation simplify the complex lifeworlds of small-scale fishing communities that are often imagined by scholars through allegories of rivalry and resource competition.Drawing on ordinary interpretations and lived practices implicated in the vernacular term sambandam (bearing multiple meanings of intimacy and entanglement), the book traces how intergroup co-operation is both affectively routinised and tactically instrumentalised across coastlines, and at sea. Given its distinct focus on translocal and ethno-religiously plural collectives, the study maps recent historic formations of diverse practices and their contentions, from networked 'piracy' and dynamite fishing, to collective rescue missions and coalitional lobbying. Moreover this work serves as an open invitation to academics, policymakers and activists for re-imagining multiple modes of ethical being and doing, and of everyday sociality among so-called 'deeply divided' societies. A rich ethnography that pays meticulous attention to a complex social fabric made up of locals, settlers and migrants, with multiple linguistic and religious affiliations, sometimes contending fishing practices, and migration and livelihoods patterns as they have been affected by tsunami, war and the aftermaths of both. It draws from and speaks to a range of disciplines - from political science and sociology, to critical geography and cultural studies, and contributes to diverse fields of inquiry, including conflict and its relationship to a "cold" peace; coastal/maritime livelihoods; identity, cooperation, and collective action. - Aparna Sundar, Assistant Professor of Politics, Ryerson University By unveiling the vast heterogeneity of fisher migrants and settlers, the book demonstrates in an excellent way how research should not merely focus on the articulations of identity, but more so the inherent properties and qualities of the diverse interdependencies they come to sustain. - Conrad Schetter, Professor of Peace and Conflict Studies, University of Bonn

One of the main goals in fisheries governance is to promote viability and sustainability in small-scale fishing communities. This is not an easy task given external and internal pressure, including environmental change and competition with other economic sectors searching for development in the coastal region. A comprehensive understanding of small-scale fisheries in their own context, and from a regional perspective, is an important step in supporting the implementation of the Voluntary Guidelines on Securing Sustainable Small-Scale Fisheries (SSF Guidelines). This book contributes to the global effort by offering knowledge, insights and lessons about small-scale fisheries in Latin America and the Caribbean. The 20 case studies included in the book make explicit the various dimensions that are intrinsic to small-scale fisheries in the region, and identify conditions and situations that affect the wellbeing of fishing communities. The book offers insights regarding the challenges faced by small-scale fisheries in the region, and, aligning with the objectives of the SSF Guidelines, provides lessons and experiences about how to make small-scale fishing communities viable while maintaining sustainable fisheries. This important book illustrates the complexity, diversity, and dynamics of small-scale fisheries in the Latin American and Caribbean region and presents experiences, tools, and approaches to lead towards sustainable and viable fisheries. The reader will gain a new understanding on the range of actions, approaches, and information needed for their successful management.John F. Caddy, International Fisheries ExpertThis book, prepared by the Too Big To Ignore partnership, constitutes a very valuable resource for policy makers, fisheries scientists, non-governmental organizations, civil society organizations, and fishing communities interested in putting in place sound management strategies, research, and actions to contribute to the sustainability of small-scale fisheries and food security in Latin America and the Caribbean region.Juan Carlos Seijo, Professor of Fisheries Bioeconomics at Marist University of Merida

This volume examines the impact of fish stock assessment and catch share arrangements in context through case studies and in terms of ecosystem, economy and society. It examines the rationalizing work of bio-economic projects, especially the institutionalization of individual transferable quota (ITQ) in fisheries: what impact have they had on fisheries and fishers? The contributing authors understand ITQ and quota management as bio-economic projects, that is, as widely deployed but locally constituted projects that combine biological and economic logics to rationalize production and, in this case, fish. Politicians and managers use these projects and the models that justify them to rationalize fisheries in favor of modern technology and for capital and species efficiency. Aimed at a diverse interdisciplinary fisheries management readership, and designed as a guide to issues emerging in any assessment of ITQ, the book is a timely investigation of the origins and diverse experiences of ITQ projects, including resistance to them, attempts to develop fisheries management around them, and experiences of the risks that come with them. Now around forty years old, ITQ has never been subject to the kind of comprehensive sustainability assessments once advocated by Elinor Ostrom, let alone the full-cost accounting of impacts at the national level that Evelyn Pinkerton recently called for. Fisheries, Quota Management and Quota Transfer offers multi-disciplinary assessments of the effects of ITQ from scholars working in eight countries. The book brings together scholars from anthropology, economics, geography, sociology, the history of science, and marine environmental history to discuss experiences from fisheries in eight industrialized countries. It considers cases from outside as well as inside the EU, including ITQ pioneers, New Zealand and Iceland. The combination allows for an unprecedented international perspective on stock assessments and share allocation systems. By emphasizing emerging, becoming, learning and transforming through knowledge, the book conceives technology as a field of power and choice, nevertheless dominated by managers through specific projects in specific contexts. Individual chapters relate bio-economic projects to separate theoretical literature, an approach that facilitates multi-disciplinary dialog.
