»Regulatory Discretion. A Critical Reconstruction«: The thesis researches the transfer of the Regulatory Discretion developed for telecommunications law to energy law. Since this transfer has led to a loss of legal protection, a new form of discretion called Subsumption Discretion is introduced into the discourse in order to describe the specific administrative activity in energy regulation, which has to create competitive market conditions, without loss of legal protection for market participants.

Passenger Transportation Law Analysis of Digital Transportation Models of the Sharing Economy«: App-based intermediation of taxi-like transportation conflicts with passenger transportation law and has been subject of court prohibitions. In this context, the study examines the Regulation of Rideselling (Uber) as an example of the Sharing Economy. The examination shows that the PBefG is more receptive to digital models of transportation than the debate sometimes suggests, but that it still prevents the platforms from fully exploiting their potential for efficiency.

»Network Security Management. Consideration of the Legal Requirements for dealing with short-term Technical Problems in the Power Grid against the Backdrop of a changing Grid Network Structure«: The thesis examines the European, national as well as other legal requirements for the management of short-term grid-related problems in the power grid. It deals with the responsibilities, the available instruments as well as their effect and relation to each other including the changes of the legal framework required to ensure a secure supply of electricity in the future and to legally implement upcoming changes of the technical grid structure.

»Issue of Noise-Related Regulations of Operation in Planning Permissions for Transport Infrastructure (Airports, Railroads, Highways)«: The operation not the existence of traffic infrastructure causes noise, which is why residents repeatedly demand regulations of operation. This study deals with the question of whether it is in principle possible to issue an operating regulation in a planning permission for an airport, a federal highway or a railroad line. Subsequently, the study ask for the possible legal basis for these regulations of operation.

»The Sovereign Distribution of Scarce Goods using the Example of the Promotion of Renewable Energies. Tenders in the EEG as a Distribution Procedure«: With the introduction of tenders, a fundamental shift took place from statutory determination to competitive determination of renewable energy support. The quantitative limitation of the renewable expansion leads to a scarcity situation, which forces the state to make a selection among the applicants. In this context, the specific subject law of renewable energies can be viewed from a general perspective on the basis of the distribution procedure.

»Digitalized Energy Supply through Decentralized Actors - The Legal Framework of Smart Contract-based Prosumer Activities in the Energy Economy«: Based on the concepts of prosumers - as a manifestation of decentralization - and smart contracts - as a manifestation of digitalization - the dissertation analyses which legal framework applies to digitalized and decentralized energy production, trading, and distribution. Based on this analysis, it is derived how the legal framework is to be adapted to enable an adequate and active involvement of the actors and to make optimal use of their potentials in the context of the energy transition.
