This book argues that the Supreme Court performs two functions. The first is to identify the Constitution's idealized "meaning." The second is to develop tests and doctrines to realize that meaning in practice. Bridging the gap between the two--implementing the Constitution--requires moral vision, but also practical wisdom and common sense, ingenuity, and occasionally a willingness to make compromises. In emphasizing the Court's responsibility to make practical judgments, Implementing the Constitution takes issue with the two positions that have dominated recent debates about the Court's proper role. Constitutional "originalists" maintain that the Court's essential function is to identify the "original understanding" of constitutional language and then apply it deductively to current problems. This position is both unwise and unworkable, the book argues. It also critiques well-known accounts according to which the Court is concerned almost exclusively with matters of moral and constitutional principle. The Negev, first published over a decade ago, told the story of some twenty years of study of southern Israel's desert. It synthesized the findings of botanists, geologists, soil scientists, agronomists, archaeologists, historians, and engineers and told how the applications of their work produced an agricultural surplus in this forbiddingly dry, hot region. , Now Michael Evenari has amplified the book with data from another decade of work. He describes the efforts at a new farm at Wadi Mashash, extends the weather data another ten years, presents further work on the adaptations of plants and animals to desert conditions, and takes a much deeper look at the historical precedents for the method of runoff agriculture, which has made the desert bloom.
Most of Richard Dorson's thirty years as folklorist have been spent collecting tales and legends in the remote backcountry, far from the centers of population. For this book he extended his search for folk traditions to one of the most heavily industrialized sections of the United States. Can folklore be found, he wondered, in the Calumet Region of northwest Indiana? Does it exist among the steelworkers, ethnic groups, and blacks in Gary, Whiting, East Chicago, and Hammond? In his usual entertaining style, Dorson shows that a rich and varied folklore exists in the Region. Although it differs from that of rural people, it is equally vital. Much of this urban lore finds expression in conversational anecdotes and stories that deal with pressing issues: the flight from the inner city, crime in the streets, working conditions in the steel mills, the maintenance of ethnic identity, the place of blacks in a predominantly white society. The folklore reveals strongly held attitudes such as the loathing of industrial work, resistance to assimilation, and black adoption of middle-class-white values. Miliworkers and mill executives, housewives, ethnic performers, storekeepers, and preachers tell their stories about the Region. The concerns that occupy them affect city dwellers throughout the United States. Land of the Millrats, though it depicts a special place, speaks for much of America.

Between the figure of Alexander Pope, a hunchback standing 4 feet 6 inches tall, and the perfect polished form of his poetry is an undeniable contradiction. Undeniable but not necessarily unfortunate, this contradiction of deformity and form may have been Pope's ultimate couplet, Helen Deutsch suggests, the paradox from which his contemporary cultural authority sprang. By restoring the poet's image to view against the cultural background that branded it as monstrous, Deutsch recasts Pope's literary career, from his translations of Homer to his imitations of Horace, as itself a form of monstrous embodiment - a stamping of his own personal, disfigured image on fragments of the cultural past. In Resemblance and Disgrace deformity appears as a poetics jointly constructed by the author and his audience, and Pope as an instrumental figure in the history of authorship whose personal vision and unique visibility have influenced succeeding images of cultural authority. Like the miniatures of which Pope was so fond, the book is at once particular in its focus and wide-ranging in its conceptual scope. While drawing on recent feminist, historicist, and materialist criticism of Pope, as well as current theoretical work on the body, it also attends closely to the local ambiguities of the poet's texts and cultural milieu, details often lost to critical view. The result is a revitalized and broadened understanding of Pope and of the processes of authorship. The harsh environment of caves - dark, damp, sparse of food - is home to a variety of "bizarre" creatures. Biologists, for their part, often treat these delicate, colorless organisms having no eyes, or at least greatly reduced eyes, as mere oddities with little to tell us about a topic as grand as evolution. Focusing on one cave-dwelling crustacean, Gammarus minus, this book shows that, to the contrary, cave life can provide a valuable empirical model for the study of evolution, particularly adaptation. Authors David Culver, Thomas Kane, and Daniel Fong marshal many years of extensive research into the genetics, ecology, morphology, and systematics of Gammarus minus. They explain how these biological factors have been shaped by physical constraints, such as the structure and development of caves and karst terrains, groundwater hydrology, and drainage basin patterns. Their work reveals the advantages of caves for studying natural selection: the highly simplified habitats found underground serve as a natural laboratory for the evolutionary biologist, and the distinctive morphological features of cave fauna provide a wealth of data on evolutionary history and natural selection. "This is clearly a time of significant transition in Japanese-American relations," Edwin O. Reischauer writes in his introduction to this timely and important book. "Are the prospects as alarming as some would argue, or is there more reason for hope?" In the penetrating essays that form this volume, the flashpoints for trouble are exposed so that we can understand the causes for the "great uneasiness" in American-Japanese relations: increasing economic rivalry, the emergence of a multipolar world, America's new interest in better relations with China and Russia, Japanese economic decline, and projected Japanese political instability. It would be easier to deal with these problems if American and Japanese cultural and political styles were similar. But they are not, and the resulting lack of communication and response is a serious handicap to solving mutual problems. In their diplomatic relations the Japanese try to avoid political confrontation and prefer to negotiate by indirection. Then, too, American images of Japan are skewed by layers of government and bureaucracy. Finally, Japanese consensus politics leads to immobility when Americans want action. The writers, in pointing out these differences, indicate how confusing all this is to U.S. policymakers. Despite these obstacles to friendship and understanding, a "cautious optimism" about the future pervades this book. The distinguished authors suggest a variety of ways to improve relations.Japan could and should take on more responsibility for Eastern stability and economic viability. In turn, the United States ought to recognize Japan as a major power with a large stake in Asia and to stress the complementarity of their economies.
From the time of Bismarck's great rival Ludwig Windthorst to that of the first post-World War II Chancellor, Konrad Adenauer, the Catholic community in Germany took a distinctive historical path. Although it was by no means free of authoritarian components, it was at times the most democratic pathway taken by organized political Catholicism anywhere in Europe. Challenging those who seek continuity in German history primarily in terms of its long march toward Nazism, this book crosses all the usual historical turning points from mid-nineteenth- to late-twentieth-century German history in search of the indigenous origins of postwar German democracy. Complementing recent studies of German Social Democracy, it links the postwar party system to the partisan traditions this new system transcended by documenting the attempts by reform-minded members of the old Catholic Center party to break out of the constraints of minority-group politics and form a democratic political party. The failure of those efforts before 1933 helped clear the way for Nazism, but their success after 1945 in founding the interdenominational Christian Democratic Union (CDU) helped tame political conservatism and allowed the emergence of the most stable democracy in contemporary Europe. Integrating those who needed to be integrated--the cultural and political conservatives--into a durable liberal order, this conservative yet democratic and interdenominational "catch-all" party broadened democratic sensibilities and softened the effect of religious tensions on the German polity and party system. By crossing traditional chronological divides and exploring the links between earlier abortive Catholic initiatives and the range of competing postwar visions of the new party system, this book moves Catholic Germany from the periphery to the heart of the issue of continuity in modern German history.

Berthe Morisot takes her place today as a founder of Impressionism and a leader in women's history. Like her colleagues - Cassatt, Degas, Monet, and Renoir - Morisot sought to represent the experience of modern life, a project that for her entailed rethinking what it meant to be a woman in the nineteenth century. Through close attention to the artist's work and its context, Anne Higonnet shows how Morisot transformed her femininity and its visual culture into Impressionist paintings. Higonnet presents a clear picture of visual traditions that, though very much a part of Morisot's world and work, figure only marginally in art history. Amateur picture making, for instance, was enormously popular among nineteenth-century women. Higonnet locates Morisot's origins in this private practice, then traces her reactions to an industrialized feminine imagery characterized by consumption and dominated by the fashion plate. This discussion provides a background and context for Morisot's imagery, but also helps to explain the look of her pictures. Focusing on formal choices - poses, props, composition, and especially brushwork - Higonnet compares Morisot's images of women with those of Cassatt, Degas, and Manet and details the emergence of her stylistic and thematic individuality. She also shows us the critical themes of Morisot's late work: her self-portraiture, her attempts, with Cassatt, at painting the female nude; and her pictorial explorations of the mother-daughter relationship. Skillfully combining social history, art criticism, and psychological insights, this engaging and abundantly illustrated volume renegotiates the boundaries of art history as well as the terms of women'sself-representation.

Since its founding in 1839, the Harvard College Observatory has pioneered in the development of modern astronomy. Its first directors early recognized the potential of spectroscopy in revealing the constitution of the stars, and of photography in determining the positions and motions of celestial objects; the library of photographic plates made under their direction provides an invaluable history of the stellar universe for the period. The Observatory also pioneered in using the talents of women, several of whom became noted astronomers, and their monumental classification of stars from spectral records constitutes a fundamental contribution to astronomical knowledge. The authors vividly portray the genesis, growth, and achievements of a major scientific institution and its relations with other observatories. Through the use of photographs and correspondence they also portray the men and women who played essential roles in the development of astronomy in the nineteenth and early twentieth centuries.
This study may be the most sophisticated statistical study of legislative voting now in print. The author asks why legislators, especially U.S. senators, vote as they do. Are they influenced by their constituencies, party, committee leaders, the President? By taking a relatively short time span, the years 1961 to 1963, the author is able to give us answers far beyond any we have had before, and some rather surprising ones at that. Constituencies played a different, but more important role in senators' voting than earlier studies have shown. Senators appeared to be responding both to the opinion held by their constituents on different issues and to the intensity with which these opinions were held. On the interrelation of constituencies and party, Mr. Jackson finds that Republicans and southern Democrats were particularly influenced by their voters. The clearest cases of leadership influence were among the non-southern members of the Democratic Party. Western Republicans, on the other hand, rejected the leadership of party members for that of committee leaders. Finally, on Presidential leadership, Mr. Jackson shows that John F. Kennedy influenced senators only during the first two years of his administration. All of these findings challenge conventional wisdom and are bound to influence future work in legislative behavior.
