Louis D. Brandeis (1856-1941) played a role in almost every important social and economic movement during his long life: trade unionism, trust busting, progressivism, woman suffrage, scientific management, expansion of civil liberties, hours, wages, and unemployment legislation, Wilson's New Freedom, Roosevelt's New Deal. He invented savings bank life insurance and the preferential union shop, became known as the "People's Attorney," and altered American jurisprudence as a lawyer and Supreme Court judge. Brandeis led American Zionism from 1914 through 1921 and again from 1930 until his death. He earned over two million dollars practicing law between 1878 and 1916 and used his wealth to foster public causes. He was adviser to leaders from Robert La Follette to Frances Perkins, William McAdoo to Franklin Roosevelt, Woodrow Wilson to Harry Truman. This lively account of Brandeis's life and legacy, based on ten years of research in sources not available to previous biographers, reveals much that is new and gives fuller context to personal and historical events. The most significant revelations have to do with his intellectual development. That Brandeis opposed political and economic "bigness" and excessive concentration of wealth is well known. What was not known prior to Strum's research is how far Brandeis carried his beliefs, becoming committed to the goals of worker participation--the sharing of profits and decision making by workers in "manageable"-sized firms. So it happened that the man who was sometimes dismissed as an outmoded horse-and-buggy liberal championed a cause too radical even for the New Deal braintrusters who were quick to follow his advice in other areas Strum charts Brandeis's development as a kind of industrial-era Jeffersonian deeply influenced by the classical ideals of Periclean Athens. She shows that this was the source not only of his vision of a democracy based on a human-scaled polis, but also of his sudden emergence, in his late fifties, as the leading American Zionist: he had come to regard Palestine as the locus of a new Athens. And later, on the Supreme Court, this Athenian conception of human potential took justice Brandeis beyond even Justice Holmes in the determined use of judicial power to protect civil liberties and democracy in an industrialized society.
This book takes a major step in psychological anthropology by applying new analytic tools from cognitive science to one of the oldest and most vexing anthropological problems: the nature of primitive thought. For a decade or more there has been broad agreement within anthropology that culture might be usefully viewed as a system of tacit rules that constrain the meaningful interpretation of events and serve as a guide to action. However, no one has made a serious attempt to write a cultural grammar that would make such rules explicit. In Culture and Inference Edwin Hutchins makes just such an attempt for one enormously instructive case, the Trobriand Islanders' system of land tenure. Using the propositional network notation developed by Rumeihart and Norman, Hutchins describes native knowledge about land tenure as a set of twelve propositions. Inferences are derived from these propositions by a set of transfer formulas that govern the way in which static knowledge about land tenure can be applied to new disputes. After deriving this descriptive system by extensive observation of the Trobrianders' land courts and by interrogation of litigants, Hutchins provides a test of his grammar by showing how it can be used to simulate decisions in new cases. What is most interesting about these simulations, generally, is that they require all the same logical operations that arise from a careful analysis of Western thought. Looking closely at primitive inference in a natural situation, Hutchins finds that Trobriand reasoning is no more primitive than our own.

This book is a sophisticated and deeply researched volume on Mao Tse-tung's early leadership and on the formative years of the Chinese Communist Peasant movement. It has been axiomatic in Asian studies that knowledge of the early years of Chinese communism would throw the most light on modern happenings. In this landmark volume, Hofheinz provides the much-needed map for understanding. Hofheinz shows how the rural revolution began, dissects with exquisite care the mentalities of the first leaders, and assesses the early gropings of peasant revolutionaries toward class struggle. He explains why Mao and others came to believe that the huge rural population was the most powerful force in China and that warfare against any visible enemies constituted progress for the Communist cause. Yet the first Chinese Communists failed miserably both as members of the Kuomintang coalition and on their own. The reasons for the great debacle of the 1920s are set out in this book for the first time in all their complexity. As important as this history is, Hofheinz declares, the lessons Mao learned from his defeats are of even greater significance. Mao and his followers shaped every decision in later years to avoid the errors of the past. The author demonstrates how Mao used ruralism, militarization, worship of numbers and not territory, and a fierce autonomy from other political groups to gain his ends.
Savanna ecosystems play a major role in the natural landscape and in the economic life of vast areas of the tropics. These grasslands are inherently fragile, yet Third World economic development makes human exploitation inevitable. The question that remains is whether utilization of the savannas for agriculture and other purposes will create sustained economic growth or a desert waste. Guillermo Sarmiento is an unquestionable authority on the grasslands of the New World. His book is the first modern, integrated view of the genesis and function of this important natural system--a synthesis of savanna architecture, seasonal rhythms, productive processes, and water and nutrient economy. Sarmiento's emphasis is on the Venezuelan savannas that he has spent a lifetime studying, but his outlook is far broader. He makes frequent comparisons with other neotropical and tropical savannas and with temperate prairies, and he offers conclusions of global importance, not only for ecologists and agronomist but for anyone concerned with the politics of Third World development.
Are American political parties on the way out? Political action committees (PACs) currently compete with parties for influence over candidates and voters; persuading a more independent and volatile electorate requires new tactics; technological innovations afford more sophisticated means to appeal for support. Many political observers express doubts about the ability of political parties to adapt to these changes and to survive, but Paul Herrnson instead suggests their survival and resurgence in this balanced assessment of party activities in congressional elections. Drawing on extensive interviews and survey data collected from nearly five hundred recent House and Senate candidates, campaign advisers, party officials, PAC executives, and journalists, Herrnson evaluates the roles of the national parties. Herrnson provides rich detail on party development and party campaign activity to predict the future of congressional elections and of the party-in-government and the party-in-the-electorate. This bold book challenges a contemporary consensus on the titanic figure of Oliver Wendell Holmes. Holmes is the acknowledged source of twentieth-century tort law, but David Rosenberg takes sharp issue with the current portrayal of Holmes as a legal formalist in torts who opposed the notion of strict liability and dogmatically advocated a universal rule of negligence, primarily to subsidize industrial development. Marshaling the evidence found in Holmes' classic The Common Law and other writings, the author reveals that the opposite was the case, and, in the process, raises troubling questions about the present state of legal scholarship. It was Holmes who founded the modern conception and justification of strict liability. He envisioned an expansive role for strict liability to augment the negligence rule in preventing and redressing injury from industrial activity. This recovery of Holmes' theory of torts provides new insights into the nature of the jurisprudence that launched the American legal realist movement, and also overturns standard interpretations of the history of tort law. Rejecting the prevailing view that either strict liability or negligence reigned exclusively, Holmes and his contemporaries reconciled the existence of both rules, and advocated reforms of tort law to protect society from the unprecedented hazards of industrial life. The parallel drawn by the book between their response and ours in grappling with the novel problem of mass torts confirms Holmes' belief in the adaptive genius of the common law.
Historical landmarks, such as wars, coups, and revolutions, seem to arise under unique conditions. Indeed, what seems to distinguish history from the natural and social sciences is its inability to be dissected or generalized in any meaningful way. Yet even complex and large-scale events like the American Revolutionary War and the French Revolution can be broken down into their component parts, and, as Bertrand Roehner and Tony Syme show, these smaller modules are rarely unique to the events they collectively compose. The aim of this book is to analyze clusters of similar "elementary" occurrences that serve as the building blocks of more global events. Making connections between seemingly unrelated case studies, Roehner and Syme apply scientific methodology to the analysis of history. Their book identifies the recurring patterns of behavior that shape the histories of different countries separated by vast stretches of time and space. Taking advantage of a broad wealth of historical evidence, the authors decipher what may be seen as a kind of genetic code of history.

For the first time Leibniz' political, moral, and legal thought are extensively discussed here in English. The text includes fragments of his work that have never before been translated. Riley shows that a justice based on both wisdom and love, "wise charity", has at least as much claim to be taken seriously as the familiar contractarian ideas of Hobbes and Locke. For Leibniz, nothing is more important than benevolence toward others, which he famously equates with justice and which he insists is morally crucial. Because Leibniz was the greatest Platonist of early modernity, Riley argues, his version of Platonic idealism serves as the bridge from Plato himself to the greatest modern "critical" idealist, Kant. With Leibniz' Universal Jurisprudence we now have a fuller picture of one of the greatest general thinkers of the seventeenth century.
The emergence of cities in the different regions of the ancient world presents two problems. First, in areas of common culture or at least of cultural contact, did the cities evolve independently, as phenomena of social, political, and economic growth, or did they emanate from a common center of origin? Second, how did the Greco-Roman city-state originate? In considering these questions, Mason Hammond has limited the ancient world to the Middle and Near East, the Indus Valley, and the Mediterranean region. He takes geographical and economic factors into account as he treats the cities historically by areas, from their first development in Sumeraround 3200 B.C, to the end of the ancient world in the middle of the sixth century A.D. Mr. Hammond concludes that the city's evolution was a phenomenon of local social development but was also influenced by older cultures. The city-state, he shows, was a creation of the Greek genius. It was diffused throughout the Greco-Ronan world, and withered with the decline of ancient culture in the early Middle Ages. The author provides brief geographical descriptions of the areas he covers. Thirteen maps give the locations of places referred to in the text. Where ancient and modern names differ markedly, both are given, in the text and in an index of the places shown on the maps. An extensive chronological survey and a general index document the text.
Analyzing the political culture of the Andean republics of Peru, Bolivia, and Ecuador and of the United States, Fredrick Pike finds in their relationships deep divergencies in values and goals. Andeans, he shows, have traditionally viewed with suspicion the tenets associated with liberal democracy, secularism, and individualistic capitalism. In a detailed study of Andean politics, economics, social classes, and cultural patterns in the nineteenth and twentieth centuries, Pike determines that revolutionary ideology often merely masked the ambitions of aspiring elites anxious to retain the traditional order but wishing to wrest its advantages from incumbent elites. He shows the appeal of Marxism and of recent external-domination, internal-dependency theories, as well as the basic conservatism of land-reform programs and approaches to the Indian problem. Pike also speculates on whether an iron law of dependency is involved in Andean relations with the United States. He discusses the role of multinational corporations and the increasing privatization of dependency. In the emerging postmodern era, Pike suggests, the values of Western-style modernity are even less viable in Andean America and indeed may not be able to survive in the United States.

Looking at a broad spectrum of writers--English, French, German, Italian, Russian and other East Europeans--Virgil Nemoianu offers here a coherent characterization of the period 1815-1848. This he calls the era of the domestication of romanticism. The explosive, visionary core of romanticism is seen to give way--after the defeat of Napoleon--to an expanded and softer version reflecting middle-class values. This later form of romanticism is characterized by moralizing efforts to reform society, a sentimental yearning for the tranquility of home and hearth, and persistent faith in the individual, alongside a new skepticism, shattered ideals, and consequent irony. Expanding the application of the term Biedermeier, which has been useful in describing this period in German literature, Nemoianu provides a new framework for understanding these years in a wider European context.

This work seeks to shed light on one of the most enigmatic masterpieces of twentieth-century thought. At the heart of Eli Friedlander's interpretation is the internal relation between the logical and the ethical in the "Tractatus," a relation that emerges in the work of drawing the limits of language. To show how the "Tractatus," far from separating the ethical and the logical into distinct domains, instead brings out their essential affinity, Friedlander focuses on Wittgenstein's use of the term "form," particularly his characterization of the form of objects. In this reading, the concept of form points to a threefold distinction in the text among the problematics of facts, objects, and the world. Most important, it provides a key to understanding how Wittgenstein's work opens a perspective on the world through the recognition of the form of objects rather than through the grasping of facts--thus revealing the dimensions of subjectivity involved in having a world, or in assuming that form of experience apart from systematic logic. Bearing on the question of the divide between analytic and Continental philosophy, this interpretation views Wittgenstein's work as a possible mediation between these two central philosophical traditions of the modern age. It will interest Wittgenstein scholars as well as anyone concerned with twentieth-century philosophy.
