Aiming for the broadest and fullest reparation of environmental damage, the idea of applying the principle of retroactivity to environmental damage that occurred in the past is defended. There is no legal provision in Brazilian legislation for its application. However, the idea of retroactivity is defended since, despite the fact that the conduct took place in the past, the harmful effects are present, and someone must be held responsible to stop and repair the damage. Likewise, in view of the peculiarity of environmental damage, the issue of future environmental damage is studied here and how case law deals with the matter, always aiming for the broadest environmental protection.

Labour intensification is a characteristic feature of modernity and has led to the excessive consumption of workers' physical and spiritual energies, revealing the incidence of work-related illnesses within the scope of the family health strategy. Historically, the conception of physiotherapy as a health area was exclusively rehabilitative, but it is known that with the implementation of primary care on the health agenda, there is a need to redefine its field of action from the perspective of Health Promoter. This book portrays the consolidation of primary health care, reframes physiotherapy with a focus on health promotion and promotes the category of work as a determining factor in the community's health and illness process, highlighting soft health technologies and their relationship with care. This paper deals with the relevance of the method as a guide for obtaining knowledge within the sphere of the Science of Religion, as well as the significance that the first rule of the Cartesian method had for the constitution of a scientific-religious programme. The aim is to analyse and draw up a dialogue between the first rule of the Cartesian method and the concept of method used by the Science of Religion, showing that the discoveries made by this science can carry with them traces and influences of this rule, which was built even before the establishment of an academic area focused on religious knowledge.

This publication is the result of a master's research project that aimed to engage in dialogue with black female teachers at the Federal University of Santa Maria (UFSM), seeking to understand the paths and journeys that these teachers went through to become teachers in higher education, and to understand the extent to which ethnic-racial and gender social relations interfere in their teaching practices. The theme to be presented and discussed in this study is more broadly related to research in education, with a focus on education in ethnic-racial relations and the educational processes triggered by black women teachers in higher education, especially in the processes in which they have or have not experienced racism and discrimination in the educational sphere. In this sense, this study assumes that Brazilian universities are still in an unequal situation, where black students are a minority and, when we look at the teaching staff, the situation is even more alarming.

This book is the result of a study that sought to investigate the perception of the elderly about ageing and sexuality. The testimonies given here by the elderly talk about pleasure, love, desire and sexual practice. It is challenging to talk about this subject. We still need to move forward in order to deconstruct the myths and taboos that permeate the culture that desire dies with age. Socio-cultural and institutional barriers need to be overcome so that the elderly can live their sexuality to the full.

This research project recognizes the eminent problem that exists in the canton of El Carmen, specifically about the inadequate commercial management of the national cocoa, being this the major product that is most traded both in the domestic and international market, becoming the livelihood of much of the population. The canton of El Carmen is located in a sector that has a suitable climate for cocoa crops. The diversity in agriculture allows finding different types of cocoa, highlighting the national or also called fine aroma being one of the most produced and best in quality. The proposal of a training plan with the objective that the producers acquire adequate knowledge encouraging in them the association, therefore the creation of a guild of cocoa farmers will be given, thus reducing the intermediation, leading to achieve an optimal commercial management of national cocoa to improve the quality of life of the producing families.

Knowing your own history is an absolutely necessary endeavour, especially when you want to build a healthy, concrete and unthreatened democracy. Knowing one's past in order to build a conscious future is just one of the facets of Transitional Justice, which is essential in post-authoritarian periods. This work, the result of research carried out for a dissertation in the Master's programme in Law and Social Justice, briefly recalls the events that led to the military dictatorship established in Brazil in 1964, up to the moment when the Brazilian Amnesty Law was challenged before the Supreme Court, and the role of the National Truth Commission established in the country. The process of "constructing" Transitional Justice in the country, as well as the process of "deconstructing" Law 6.683 of 1979, is briefly described in these writings, with the aim of explaining what this transactional movement is and how the judgement in the Gomes Lund vs Brazil case by the Inter-American Court of Human Rights made it impossible to apply the Brazilian Amnesty Law, a fact that is still unresolved in the courts today. These lines are intended to bring the reader closer to history itself.

Bee pollen is a product made from flower pollen, a mixture of nectar and bee secretions containing digestive enzymes. It can present different colors, ranging from creamy white to red. Rich in macronutrients, vitamins and antioxidants. It contains, to a lesser extent, minerals, phenolic compounds, flavonoids, sterols and terpenes. It contains most of the essential amino acids and bioactive compounds that give it antioxidant, antimicrobial, hypolipidemic and immunomodulatory activity, making it an indispensable food for human nutrition and health. Therefore, a product for human consumption was developed with this food. The objective of the study was to evaluate the acceptability of a food product made with bee pollen from the Cooperativa Integral de Producción Apicultores de Cuilco, Huehuetenango, Guatemala. For the formulation of the product, its macronutrient and micronutrient content was determined; subsequently, ingredients were selected that would combine with the organoleptic characteristics of bee pollen and complement its nutritional value.

This work analyses the limits of Judicial Activism from the perspective of the Constitutional State. The problem that guided the research involves the question of whether there is democratic legitimacy for Judicial Activism in relation to the mitigation of Fundamental Rights embodied in individual freedoms in the system of the Constitutional State. The rule of law, the tripartition of powers and Fundamental Rights are the mainstay of the Constitutional State and are designed to protect the rights of the individual in the face of abuse by the State. Among the specific research objectives, we seek to identify the power relations in the contemporary State and the constitutional guarantees for the protection of the citizen; to understand how Fundamental Rights and the freedoms of the citizen have evolved in the Democratic State of Law; and to verify the jurisdictional function and the limits of interpretation of the Members of the Judiciary in the aegis of the Constitutional State.

This study presents a general investigation into the theoretical framework and the procedural and methodological development underlying my work in painting. The main theme consists of a general survey of the concept of anthropomorphism, particularising its manifestation in dog painting, and how this term applies to my work. The first chapter gives a general idea of the term Anthropomorphism, from its origins to its scope in the fields of Art, Religion and Science, followed by a particularisation of this phenomenon in dog painting in the West, from the 15th century to the present day. The second chapter of this work consists of a reflection on the choice of the dog as a theme, how the concept of anthropomorphism manifests itself in the practical work of painting, and the procedural and methodological development underlying the practical work.

The book will analyse the effectiveness of these rights in relation to private contractual relations, based on an understanding of the evolution from liberal to social constitutionalism, since, as is well known, modern constitutional hermeneutics has promoted a new interpretation of civil norms, so that man's existential issues have priority over property issues, which culminated in the emergence of the Theory of Horizontal Effectiveness.

This book explores the notion of hyperrealism in the novels of P. Deville. The choice and examination of the texts are based on the desire to show that the deployment of media in the internal organization of contemporary novelistic fiction is an innovative aesthetic in which the attempt to integrate the real now involves techniques for magnifying the real. The importance given to detail and the abundance of media that constitute its representational detours lead to the derealization of referents, through a paroxysm of representation, in the process of apprehending reality. The aesthetic resulting from such a practice reveals an apparent fragmentation, not only of the characters under the spell of the multiplicity of representation, but also of the novel itself. This fascination enables the author to take a look at media paradigms and their corollaries, to denounce the practices of contemporary society caught up in simulacra and simulation. It's a painful rewriting that reveals the deep malaise of the individual in a society that depersonalizes him and tends to place him on the same level as everyday consumer objects.

This book is a synthesised version of a longitudinal study of a group of educators whose conceptions of childhood and educational guidelines were observed over a seven-year period, from the time they were students in their initial training at the Escola Superior de Educação de Setúbal to the time they were in-service educators in various contexts. The study puts the interviewees' discourse into dialogue, both with conceptions derived from academic discourse and with testimonies from the author's experiences as a trainer involved in both the theoretical side and in monitoring research projects carried out by the students during their internships in nursery schools and kindergartens. Closely related to the author's teaching activity and arising from a need felt in that practice, this study has the characteristics of an action-research-training. The study methods and conceptions of these former students in relation to the academic productions they carried out during their initial training were also analysed, allowing these methods and conceptions to be linked to the professional development of the interviewees.

Plato and Aristotle, master and disciple respectively, devoted part of their time to thinking about mathematics. Not agreeing in theory with the ideas of the master, Aristotle developed a different analysis, one that "distanced" himself from the master, above all because he did not see maths as something disconnected from the sensible reality of men. Plato's theory of the sensible and intelligible worlds is based on the idea that maths occupies a prominent place in the world of ideas, or at least a safe path to that world. This apparent contradiction between the Platonic academy and the work of Aristotle is what surrounds our present work.

This research work prior to obtaining the title of technologist in assistance in inclusive education is important because the project will help deaf students of the Special Educational Unit Fe y Alegria to avoid being easy prey to the dangers found on the internet and social networks (cyber bullying, harassment, sexting, sextortion among others). To orient teachers and parents so that they can be a guide in the use of this technological tool that nowadays has become something very indispensable for our daily life. In recent years we can see that everything we do is based on the internet especially the communication processes and it is in this part where students with hearing impairment by their condition do not find a correct guide for use as they are also part of a society and need to communicate, make friends using the current media like all young people and therein lies the importance of having a manual that informs them about everything they can find to be users of these social networks. The proposal consists in the elaboration of a manual.

Abortion is a subject that generates a lot of controversy, while there is a great taboo about its discussion, due to the immense diversity of opinions, of a moral, religious and legal nature about this practice, bringing up countless questions, would a woman be autonomous enough, owner of her body to decide whether or not to generate another life? How does the criminalisation of abortion affect women and society as a whole? What about women's other fundamental rights? Are the conditions for abortion the same for all women? With these questions in mind, abortion is an extremely important issue that directly affects women's lives, as well as society, and should therefore be debated openly, from a neutral and belief-free perspective, so that an assessment can be made of the real effectiveness of criminalising this conduct.

This work is a study of the cross-default clause within Brazilian contract law, in order to establish whether it fits the current rules and principles of civil law. Firstly, the evolution of obligations, their ramifications and how default is remedied under the rules laid down in the 2002 Civil Code will be developed, followed by a search for an idea of fair and equitable contract law, which after several phases is now based on constitutional principles and adopts a social stance, removing from contractual legal business any clauses that could harm one of the parties to the contract. It can therefore be concluded that the clause under analysis, also known as cross default, is not merely a means of facilitating receipt by the creditor party, but an obligation contracted that harms the less economically favoured party.

This book aims to broaden the discussion about play and the importance of this activity for children's development. It takes institutional childcare as its backdrop for discussion. Based on the theoretical contribution of the cultural-historical perspective, the text seeks to reflect on child development and places play as a cultural production of the child.

The purpose of the research was to determine the relationship between democratic leadership and management quality in commercial companies in the city of Barranquilla. Descriptive and correlational methodology, non-experimental, transectional and field design; the study population consisted of 27 employees: (3) operations managers, (24) store administrators of Carulla, Súper almacenes Olímpica (S.A.O) and Almacenes ÉXITO, to whom a questionnaire was applied; the reliability of the instrument was 0.93 with the Cronbach's Alpha coefficient, which indicates that it is highly reliable. The descriptive statistical analysis, with distribution of frequencies and percentages, to determine the relationship between the variables, Spearman's correlation was used. The results show the relationship between both variables with a high intensity, to the extent that democratic leadership increases, it is more likely to achieve a higher quality of management and vice versa. It was concluded that, due to deficiencies in democratic leadership approaches and tendencies, they considerably affect the consolidation of management quality factors.

Administrative contracts are characterised as an instrument used by the Public Administration to pursue its objectives. They are a kind of manifestation of the Democratic Rule of Law, since they enable the public manager to apply financial resources more efficiently. Because of this social function and also under the guise of the prerogatives and guiding principles of administrative contracts, the Public Administration has the power to manage, supervise and apply penalties within the scope of contracts. In this context, in the light of Law 8.666/93, the book highlights the importance of the Public Administration's sanctioning power, regarding the extent of the effects of the administrative sanctions of Temporary Suspension and Declaration of Unacceptability, applied to bidders and contractors in the event of total or partial non-performance of administrative contracts. To compile her approach, the author sought to present legal aspects, doctrinal and jurisprudential divergences, taken from a constitutional conception of protecting the fundamental rights and guarantees of bidders and contractors.

The most important herbicides are those with glyphosate and paraquat and are in great demand by farmers. The two differ in that the first kills weeds systematically and the other on contact. In the market there are more than 60 brands of herbicides containing glyphosate as raw material - imported - and 10 brands with paraquat. This product had a turnover of more than USD112 million in 2008. These products are imported and there are more than 60 companies that market them. The leading companies are Agripac, Ecuaquímica, Bayer and others. Herbicides are part of the pesticide family, which includes inputs called fungicides, insecticides and nematicides. Fernando García, director of Croplife, which groups the transnational companies producing these inputs, says that in the country glyphosate is mixed with other products and packaged for marketing. For each crop there is a different formula.

Solidarity", a much-used word, is a recent word in the history of Western ideas and represents a complex knot of relationships that attempt to respond to a certain human condition. Everyone tries to find in it appeals to a human "essence" that goes beyond the subject and that opens up to others, whether circumstantially or permanently; emblematic projects, small and majestic works of charity, collaboration in the face of some human difficulty, empathy in the face of pain and frustration, displays of affection and many other actions and attitudes are labelled with the genitive of "solidarity". There are some who place it as a synonym for volunteering and cooperativism, and there are even others who deny it as an element that disturbs the demands of social justice that should exist between human beings or between institutions and individuals. But above all, solidarity is presented as a new way of referring to the human condition, in order to highlight its inescapable social character.

The purpose of this book is to analyse the Special Protection of Children and Adolescents, focusing on the care provided by CREAS - Specialised Social Assistance Centres - to children and adolescents who are victims of sexual violence in Greater Cuiabá between 2006 and 2010.

Asthma remains one of the most common chronic diseases in the world. It poses a real public health problem. It is essentially a childhood disease, as it generally begins early in life. Asthma continues to elude specific definition, and can currently only be characterized by functional terms. There is no gold standard for diagnosing asthma; no physiological, immunological or histological test is specific for diagnosis, and only response to treatment can confirm the disease. Asthma is a multifactorial disease in which it is difficult to distinguish causes from triggers. Asthma is a chronic inflammatory disease of the bronchial tubes, with hyperreactivity leading to bronchoconstriction in response to stimuli. In-depth treatment, based on inhaled corticosteroids, is therefore essential for optimal symptom control and improved quality of life. Management must be multidisciplinary and comprehensive, in close partnership with the family. The therapeutic approach of the future is undoubtedly personalized medicine.

The analysis of the restaurant environment within an economy based strictly on the tourism sector is of the utmost importance because customers are becoming more and more demanding in relation to the service they demand and request from food and beverage providers. In view of this complexity faced by business managers in this business segment, investigating service quality and customer satisfaction allows them to strategically visualise the different variables under study, so that decision-makers can identify, evaluate and analyse all those factors or dimensions that have a greater or lesser impact on the perception of diners. Service quality is a study phenomenon of enormous importance for decision-makers today; in other words, the objectivity dictated by strictly economic thinking through price is nowadays surpassed by subjectivity in the understanding of customer perceptions.
