This paper is framed within the historical evolution of the so-called theory of the separation of powers of the State, as an expression of modern democratic states. Thus, where in the beginning there were kings or emperors, today there are three great powers of the State: the Executive, the Legislative and the Judiciary. With this historical evolution, an inherent and palpable tension has also arisen over time between these three powers of the State, since the powers and attributions that kings or emperors had solely and exclusively in one of these three powers had to be channelled, also adapting their limits and control over them.The decree of economic emergency, i.e. the special attribution of the President of the Republic to dispose of a constitutional 2%, calculated on the amount of the expenses authorised by the Budget Law for exceptional cases, thus giving course to payments/expenditures that are not expressly authorised by said law, will be used as a framework for analysis with respect to the private powers of the Executive and Judicial Power, control and limits of them.

Ce document s'inscrit dans l'évolution historique de la théorie dite de la séparation des pouvoirs de l'État, en tant qu'expression des États démocratiques modernes. Ainsi, alors qu'à l'origine il y avait des rois ou des empereurs, il existe aujourd'hui trois grands pouvoirs de l'État : l'exécutif, le législatif et le judiciaire. Avec cette évolution historique, une tension inhérente et palpable est également apparue au fil du temps entre ces trois pouvoirs de l'État, puisque les pouvoirs et attributions que les rois ou les empereurs avaient uniquement et exclusivement dans l'un de ces trois pouvoirs ont dû être canalisés, en adaptant également leurs limites et leur contrôle sur eux.Le décret d'urgence économique, c'est-à-dire l'attribution spéciale au Président de la République de disposer d'un montant constitutionnel de 2 %, calculé sur le montant des dépenses autorisées par la loi budgétaire pour les cas exceptionnels, donnant ainsi lieu à des paiements/dépenses qui ne sont pas expressément autorisés par ladite loi, sera utilisé comme cadre d'analyse en ce qui concerne les pouvoirs privés du pouvoir exécutif et judiciaire, leur contrôle et leurs limites.

O presente trabalho enquadra-se na evolução histórica da chamada teoria da separação de poderes do Estado, como expressão dos modernos Estados democráticos. Assim, onde no início existiam reis ou imperadores, hoje existem três grandes poderes do Estado: o Executivo, o Legislativo e o Judiciário. Com esta evolução histórica, surgiu também ao longo do tempo uma tensão inerente e palpável entre estes três poderes do Estado, uma vez que os poderes e atribuições que os reis ou imperadores tinham única e exclusivamente num destes três poderes tiveram de ser canalizados, adaptando também os seus limites e o controlo sobre eles.O decreto de emergência económica, ou seja, a atribuição especial do Presidente da República para dispor de 2% constitucionais, calculados sobre o montante das despesas autorizadas pela Lei do Orçamento para casos excepcionais, dando assim lugar a pagamentos/despesas que não são expressamente autorizados pela referida lei, será utilizado como quadro de análise no que diz respeito aos poderes privativos do Poder Executivo e do Poder Judicial, controlo e limites dos mesmos.

Il presente documento si inquadra nell'evoluzione storica della cosiddetta teoria della separazione dei poteri dello Stato, come espressione degli Stati democratici moderni. Così, mentre all'inizio c'erano re o imperatori, oggi ci sono tre grandi poteri dello Stato: l'esecutivo, il legislativo e il giudiziario. Con questa evoluzione storica, nel tempo è nata anche una tensione intrinseca e palpabile tra questi tre poteri dello Stato, poiché i poteri e le attribuzioni che i re o gli imperatori avevano solo ed esclusivamente in uno di questi tre poteri hanno dovuto essere incanalati, adattando anche i loro limiti e il loro controllo su di essi.Il decreto di emergenza economica, ossia l'attribuzione speciale al Presidente della Repubblica di disporre di un 2% costituzionale, calcolato sull'ammontare delle spese autorizzate dalla Legge di Bilancio per casi eccezionali, dando così corso a pagamenti/spese non espressamente autorizzati da tale legge, sarà utilizzato come quadro di analisi rispetto ai poteri privati del Potere Esecutivo e Giudiziario, al controllo e ai limiti degli stessi.

Dieses Papier ist in die historische Entwicklung der sogenannten Theorie der Gewaltenteilung im Staat als Ausdruck moderner demokratischer Staaten eingebettet. Wo es also am Anfang Könige oder Kaiser gab, gibt es heute drei große Staatsgewalten: die Exekutive, die Legislative und die Judikative. Mit dieser geschichtlichen Entwicklung ist im Laufe der Zeit auch ein inhärentes und spürbares Spannungsverhältnis zwischen diesen drei Staatsgewalten entstanden, da die Befugnisse und Zuständigkeiten, die Könige oder Kaiser einzig und allein in einer dieser drei Gewalten hatten, kanalisiert werden mussten, wobei auch ihre Grenzen und ihre Kontrolle angepasst werden mussten.Das Dekret über den wirtschaftlichen Notstand, d.h. die besondere Ermächtigung des Präsidenten der Republik, über einen verfassungsmäßigen Betrag von 2 % zu verfügen, der auf der Grundlage der vom Haushaltsgesetz für Ausnahmefälle genehmigten Ausgaben berechnet wird, und somit Zahlungen/Ausgaben zu veranlassen, die von diesem Gesetz nicht ausdrücklich genehmigt sind, wird als Rahmen für die Analyse der privaten Befugnisse der Exekutive und der Judikative, ihrer Kontrolle und ihrer Grenzen dienen.
