Aufgrund der Zugriffsmöglichkeit in der Zwangsvollstreckung ist die Marke auch interessant für Gläubiger des Markeninhabers. Die Lizenzierung der Marke durch den Markeninhaber sowie der Zugriff auf die Marke durch dessen Gläubiger in der Zwangsvollstreckung können aufeinandertreffen. Geht eine bereits lizenzierte Marke auf einen neuen Inhaber über, greift der sog. Sukzessionsschutzes des Lizenznehmers, § 30 Abs. 5 MarkenG. Die Vorschrift regelt, dass eine vorher erteilte Lizenz von einem Rechtsübergang nicht ¿berührt" wird. Dies gilt auch für einen Rechtsübergang im Rahmen der Zwangsvollstreckung. Die Autorin untersucht welche Rechtswirkungen daraus im Einzelnen folgen.

In this monograph, the author demonstrates that the Acts of the Apostles is a highly creative hypertextual reworking of the Letter to the Galatians, with over 500 strictly sequentially organized conceptual and linguistic correspondences between Acts and Galatians. This hypertextual dependence on Galatians explains numerous surprising features of Acts. Critical explanations of these features, which are offered in this monograph, ensure the reliability of the new solution to the problem of the relationship between Acts and the Pauline and post-Pauline letters.

The bipartite work titled Philosophical and Translatological Wanderings in Moominvalley explores Tove Jansson¿s renowned children¿s classic to illumine its inherent double-address mode. Part one discusses the plentiful philosophi-cal hypotexts of the Moomin series, ranging from Parmenides to Westermarck and geared to an adult readership. Part two examines the Polish translation of anthroponyms, humour and cuisine terms as central to the Moominvalley idiom and the poetics of the saga. By identifying translation techniques and linguistic shifts, the author provides comparative insights into how the source and target texts address their respective audiences. By highlighting the triumphs and failures of the Polish Moomin books, the argument spells out the implications of double address for translation and translation studies.

This dissertation investigates the influence of large family shareholders on financial decisions and the performance of listed firms in Germany. This country is especially interesting, as the German corporate governance system is considered less investor- friendly with a limited influence of shareholders on managerial decisions. Based on the incentive structure of family blockholders and their influence in corporate boards, the four studies offer a novel approach to analyzing the financial behavior of family firms. They use a hand-collected panel dataset identifying blockholders and every board position in 278 corporations. The dissertation demonstrates that the degree of family involvement in boards significantly influences working capital and earnings management as well as stock market performance and provides contributions for academia and practitioners alike.

Der ordre public-Vorbehalt im Schiedsverfahrensrecht ist eine abstrakte Materie, die erst durch eine Aufarbeitung der legislativen Vorbereitungen zu den entsprechenden Regelwerken auf internationaler und nationaler Ebene sowie durch die Analyse der Rechtsprechung an Konturen gewinnt. In diesem Werk werden die einzelnen Materien geschildert, in denen ordre public-Verstöße angenommen werden, aber auch die übergreifenden Zusammenhänge herausgearbeitet. Insofern verdient der Ansatz des Verfassers, ein abstraktes Anwendungsmuster zu finden, durchaus Zuspruch. Er ist für eine rechtsvergleichende Arbeit, die deutsches und russisches Recht vergleichend behandelt, ein wertvolles tertium comparationis.

This book analyzes the various ways of coming to terms with the Emmett Till case in US fiction. The 1955 lynching of the fourteen-year-old black youth in the Mississippi Delta raised a cultural trauma in the US collective imaginary that particularly pierced the African American community, later resulting in a recurrent motif that this monograph conceptualizes as the Emmett Till trauma. This motif has historically permeated the whole spectrum of US society, springing up in manifold ways and artistic manifestations, but why does it continue to reverberate with such prominence nowadays? And which strategies have the different communities been adopting to cope with it over the years? This book seeks in literature the answers to these central questions, as it analyzes the ways in which several social groups come to terms with the Till trauma, focusing on the three major novels inspired by the tragic incident: Bebe Moore Campbell¿s Your Blues Ain¿t Like Mine (1992), Lewis Nordan¿s Wolf Whistle (1993), and Bernice L. McFadden¿s Gathering of Waters (2012). La obra Recursos prosódicos en la marcación discursiva tiene como propósito dar cuenta de los fenómenos prosódicos que utilizan seis usuarios de la variedad del español tapatío a fin de marcar el discurso en un corpus de entrevistas sociolingüísticas. Dichas entrevistas se aplicaron a seis informantes de 18 a 35 años con un nivel de instrucción alto.Por un lado, los informantes recurrieron a movimientos ascendentes de la curva melódica, saltos tonales y escalonamiento descendente a fin de marcar el discurso. Por otro lado, los informantes se sirvieron de ascensos en las sílabas finales del segmento discursivo anterior a ciertos marcadores discursivos y descensos en las sílabas iniciales de los propios marcadores para reforzar los valores pragmático-discursivos de los marcadores en cuestión.

Nous nous penchons, en particulier, sur l¿enseignement explicite et structuré du lexique spécialisé pour le français L2, en relation avec le développement non seulement de la compétence strictement terminologique, mais aussi avec la compétence « méta », relevant de la maîtrise du fonctionnement des termes. Après l¿identifi cation d¿un noyau de notions métaterminologiques, notre objectif principal est de proposer des pistes méthodologiques pour leur enseignement basé sur l¿exploitation des corpus spécialisés, dans la conviction qüune synergie effi cace peut s¿instaurer entre la compétence métaterminologique et l¿exploitation d¿une ressource numérique pour des fi ns didactiques. Des applications possibles sont proposées relativement au domaine du commerce.

El libro investiga las funciones terapéuticas del espacio en tres novelas de Marcela Serrano, Antigua vida mía (1995), El albergue de las mujeres tristes (1998) y Nuestra Señora de la Soledad (1999). Para estos fines se emplea la metodología de los paisajes terapéuticos, originaria de la geografía, cuya aplicación al análisis de la literatura ha sido escasa hasta la fecha. Serrano crea las narrativas de la enfermedad a través de las cuales se manifiestan las contradicciones de las transformaciones posmodernas y de la transición democrática chilena junto con sus consecuencias para las mujeres y yuxtapone estas reflexiones críticas con la poética espacial, que acentúa el carácter curativo de los lugares y su rol en la reconstrucción de la identidad femenina.

Ce troisième volume en examine dix-huit, ce qui, sur l¿ensemble des trois volumes, porte le nombre des entrées à quatre-vingt-sept. Focusing on the period of state socialism, the authors provide various examples of how musicians ¿ professionals and amateurs alike ¿ borrowed songs from distant times and places, reinventing them in a new political, technological, and esthetic environment. The case studies deal with a wide range of genresand styles that played an important role in Hungary, such as operetta, protest song, folk, jazz, pop, and rock. Placing the Hungarian experience in a regional context, the collection also gives insight into the music scenes of the neighboring countries through a major comparative study on the Beatles adaptations in the Eastern Bloc.
