Polizeirecht und Straf- und Strafverfahrensrecht unterscheiden sich fundamental und sind von Verfassungs wegen strikt voneinander zu trennen.Die bestehenden Eingriffsschwellen der konkreten Gefahr und der zureichenden Anhaltspunkte nach § 152 Abs. 2 StPO haben rechtsstaatliche Qualität. Während das Polizeirecht ein Vorfeld der konkreten Gefahr vorsieht, in dem insbesondere Organisierte Kriminalität und Terrorismus vorbeugend bekämpft werden können, erlaubt das Strafverfahrensrecht keine in das Vorfeld des Anfangsverdachts ausgreifenden Ermittlungen. Dieser Unterschied verdeutlicht die operative Dimension des Polizeirechts in seiner kriminalstrategischen Ausrichtung.
