It is shown that in the case of a state participation, corporate law and not public law applies in principle. On the basis of constitutional law, there may be exceptions to this rule. For example, in the case of a participation of the federal government, the duty of confidentiality of the supervisory board of a stock corporation may have to be reduced due to constitutional law.
